Locations of Equipment. (a) The Equipment (other than cash dispenser machines, vehicles or Equipment out for repair) of the Loan Parties are not stored with a bailee, warehouseman, or similar party and are located at, or in transit between, the locations identified on Schedule 4.26(a) (as such Schedule may be updated pursuant to Section 5.15); provided, that, and notwithstanding the foregoing, certain portions of the Equipment with an aggregate book value equal to or less than $100,000 may be located at a location or locations other than those locations identified on Schedule 4.26(a).
Locations of Equipment. Fixtures, and Inventory. As of the date of this Security Agreement, all of the Debtor's Inventory, Equipment, Fixtures, and other tangible Collateral are located solely at the locations described in Schedule 3.3. All of such locations are owned by the Debtor except for locations (a) which are leased by the Debtor as lessee and designated as such in Schedule 3.3 and (b) at which Collateral is held in a public warehouse or is otherwise held by a bailee or on consignment as designated in Schedule 3.3. Schedule 3.3 correctly identifies the landlords or mortgagees, if any, of each of the Debtor's locations identified in Schedule 3.3. Except for the Persons identified on Schedule 3.3 who hold Collateral in the capacity designated thereon and any other Person hereafter identified pursuant to Section 4.1(g), no Person other than the Agent has possession or control of any of the Collateral. Schedule 3.3 includes a complete and correct description of all real Property on which any of the Debtor's fixtures are located as of the date hereof. Schedule 3.3 includes a complete and correct description of all the following as of the date hereof: (i) all equipment for which a certificate of title has been issued, (ii) all vessels documented under Chapter 000, Xxxxx 00, Xxxxxx Xxxxxx Code (the Ship Mortgage Act) or for which an application for documentation is pending, and (iii) all aircraft.
Locations of Equipment. All of the Equipment is, as of the date hereof, located at the places specified in Schedule 4(b).
Locations of Equipment. All Eligible Equipment financed hereunder shall be located at all times at Borrower’s principal place of business in Petaluma, California, or with respect to Soft Costs, such other place of business located within or outside the United States disclosed on the Supplement or, if not so disclosed, approved by Lender in writing prior to the Funding Date of any Soft Cost Loan. Borrower shall provide a monthly statement of all Equipment financed by Lender which shall include the location(s) of all such Equipment.
