OPTION TO LEASE ADDITIONAL SPACE. Subject to the terms and conditions hereinafter set forth, and provided Tenant is not then in default under the terms of this Lease, the Landlord hereby grants to Tenant an option to lease any space on the eighth (8th) floor of the Building as such space becomes available (the "Expansion Space"). The Expansion Space shall be leased to Tenant at the Base Rent (on a per square foot basis) in effect with respect to the Premises as of the date Tenant exercises its option. Landlord shall give Tenant notice of the available space, setting forth the material terms and conditions of the Lease. Following receipt of such notice from Landlord, Tenant shall have five (5) business days in which to notify Tenant in writing of its intent to exercise its option with respect to the Expansion Space. If Tenant shall exercise its option with respect to Expansion Space, Tenant shall have an additional five (5) business days to execute and deliver to Landlord a lease agreement (in the form of an amendment to this Lease) with respect to such space. Tenant acknowledges and decrees that any such Expansion Space shall be leased by Tenant in its "As Is" condition, and that Landlord shall have no obligation to alter, refurbish or improve such space, except as hereinafter provided. In the event Tenant exercises its option to lease Expansion Space on the eighth (8th) floor of the Building, as herein set forth, such Expansion Space shall constitute part of the Premises, effective as of the date an amendment to Lease is executed by both parties, and EXHIBIT "A" shall be amended to designate the expanded Premises. If, as a result of Tenant's lease of the Expansion Space, Tenant is the sole tenant on the eighth (8th) floor of the Building, and the Premises constitute a single suite of offices, then Landlord shall have the right to reconfigure the space on the eighth (8th) floor to reflect a one-tenant occupancy of such suite of offices. Such reconfiguration of space may include, without limitation, the elimination of common areas (including hallways, corridors, bathrooms and mechanical rooms), which areas shall be incorporated into the square footage comprising the Premises, and the Premises shall constitute the entire eighth (8th) floor of the Building for all purposes. Provided Tenant exercises the option to lease Expansion Space hereunder no later than December 31, 1996, Landlord shall make improvements to the Expansion Space at a cost not to exceed $21,152. OPTION TO LEASE ADDITIONAL SPACE. If additional property is acquired by the Landlord, then during the Term of this Lease and any renewals thereof, Tenant shall have the limited option to lease only those areas shown as the “Additional Space” on Exhibit D attached hereto and incorporated by reference, by adding the Additional Space to this Lease at a rate to be negotiated in good faith between Landlord and Tenant.

OPTION TO LEASE ADDITIONAL SPACE. For and in consideration of the sum of -------------------------------- TEN AND NO/100 Dollars ($10.00), the receipt and sufficiency of which are hereby acknowledged by Landlord, Landlord hereby grants to Tenant the option to lease an additional approximately 35,156 rentable square feet of office space ("Option Space") on the first floor of the Facility, as described on Exhibit "C" attached hereto and made a part hereof for all purposes, at the then applicable Rent for office space under this Lease Agreement. In the event Tenant exercises this option, any portion of the Option Space taken by the Tenant ("Expansion Space") shall be part of the Leased Premises as defined in this Lease Agreement.
OPTION TO LEASE ADDITIONAL SPACE. This Rider is attached to and made a part of that certain Standard Office Lease Gross (the "Lease"), dated March 5, 1992, between ST Lending Inc. ("Lessor"), and Caseware, Inc. ("Lessee") for the premises known as Suitx 000, 000 Xxxxxxxx, Xxxxxx, Xxxxxxxxxx (xxe "Premises"). Defined or initially capitalized terms in this Rider have the same meaning as in the Lease. The provisions of this Rider shall supersede any inconsistent or conflicting provisions of the Lease. Lessor grants to Lessee an option (the "Space Option") to lease approximately 3300 square feet of space located on the first (1st) floor of the Building in which the Premises are located (the "First Floor Additional Space"). The First Floor Additional Space is shown as the area marked with diagonal lines on Exhibit D attached to the Lease. Lessee may exercise the Space Option by giving unconditional written notice to Lessor that Lessee is exercising the Space Option ("Lessee's Notice"). Lessee shall deliver Lessee's Notice only after the Second Floor Expansion Date and must deliver Lessee's Notice by on or before the first (1st) day of the thirty-sixth (36th) month of the Lease term (the "Option Termination Date"). If Lessor fails to receive Lessee's Notice by on or before the Option Termination Date, then all rights of Lessee to lease the First Floor Additional Space under this Rider shall automatically terminate, and Lessor shall thereafter have no further obligation to lease the First Floor Additional Space to Lessee and shall thereafter have the unconditional right to lease the First Floor Additional Space to third parties on any terms and conditions that Lessor thereafter negotiates, without further obligation to Lessee.
OPTION TO LEASE ADDITIONAL SPACE. 5.1 As long as (1) Tenant is not in default under the Lease beyond any applicable grace period; and (2) space in the Building becomes available for lease prior to the Termination Date, Landlord shall first notify Tenant that such additional space is available by giving Tenant written notice (a “Leasing Availability Notice”) specifying the date of availability of such space and sending Tenant an addendum to the Lease whereby Tenant may lease the additional space in accordance with the provisions of this Fifth Amendment. Within ten (10) calendar days of Tenant’s receipt of such Leasing Availability Notice, Tenant shall notify Landlord whether or not Tenant elects to lease the additional space pursuant to this paragraph. In the event Tenant elects to so lease the additional space, Tenant shall execute and deliver to Landlord the addendum to the Lease whereby Tenant shall lease the additional space for a term to expire on the Termination Date.

OPTION TO LEASE ADDITIONAL SPACE. Tenant shall, upon six (6) months written notice to the Landlord, have the right to Lease approximately 4,000 s.f. on the third floor of the building, located at 44 Gxxxxxxxxx Xxxxxx, X.X., xnd identified as Exhibit B to this Lease, at the same terms, covenants and conditions of this Lease. Tenant shall also reimburse existing tenant of the "subject" third floor space for all unamortized tenant improvement costs (based upon an original ten year amortization). Tenant shall also pay for all reasonable moving (relocation) costs.
