Other Delays. Seller shall provide Purchaser prompt written notice, including relevant information, when it has knowledge that any permits, licenses, or other approvals required for the performance of this purchase order and that are to be obtained by Seller are unable to be obtained or have expired, been cancelled, suspended, revoked, or otherwise rendered invalid.

Other Delays. It is hereby clarified that ISR shall not bear any responsibility and/or liability in connection with any and all delays that may occur in the Project (including, but without derogating from the generality of the above, pursuant to Force Majeure events), all except Entitling Delays and Suspension, which in relation thereto the provisions of Sections 9.5 or 9.6 above (as applicable) shall apply, all unless expressly provided to the contrary in these General Terms. Without derogating from the above, the Contractor shall not be entitled to any payment and/or any remedy or relief, of whatever kind and nature, from ISR in connection with any and all delays and suspensions in the Project, unless entitled to it pursuant to an express provision in these General Terms.

Other Delays. Any delay in the construction of the Work caused byTenant Delay” including any one or more of the following: (i) Tenant’s request for materials, finishes or installations other than the standard materials, finishes, or installations provided by Landlord from time to time in its sole discretion, or (ii) Tenant’s failure to timely prepare and submit any plans, specifications and construction drawings for Landlord’s review, or to timely review and approve any plans, specifications and construction drawings submitted by Landlord, within the time specified in this Exhibit “B”, or (iii) any delays in obtaining governmental approvals, permits or licenses with respect to any of the Work (including delays due to rejection and necessary modifications of any documents submitted for review) due to any failure of plans, specifications and construction drawings prepared or modified by Tenant or Tenant’s Agents to comply with applicable laws, codes or governmental requirements, (iv) Tenant’s failure to timely install its furniture, trade fixtures, equipment, wiring and cabling, or any other work or improvements for which Tenant is responsible, or (v) any other delay requested or caused by Tenant or Tenant’s Agents, shall not, in any event, delay the Relocation Space Commencement Date, which shall occur on the date it would have occurred but for such Tenant Delay. Other Delays. In the event that Landlord shall be delayed in or prevented from the performance of any act by reason of strikes, lockouts, unusual delays in transportation, unavailability of materials, acts or omissions of contractors and subcontractors, failure or unavailability of power, unavailability of fuel, restrictive governmental laws or regulations, fire or other casualty, inclement weather, riots, insurrections, the act, failure to act or default of the other party, war or other reason beyond its control, then performance of such act shall be excused for the period of the delay and the period for the performance of such act shall be extended for a period equivalent to the period of such delay. Notwithstanding the foregoing, lack of funds shall not be deemed to be a cause beyond the control of Landlord.

Such causes may include, but are not restricted to, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, freight embargoes, and unusually severe weather.

  • Unavoidable Delays Delays due to acts of God, acts of public agencies, labor disputes, strikes, fires, freight embargoes, inability (despite the exercise of due diligence) to obtain supplies, materials, fuels or permits, or other causes or contingencies (excluding financial inability) beyond the reasonable control of Landlord or Tenant, as applicable. Landlord shall use commercially reasonable efforts to provide Tenant with prompt notice of any Unavoidable Delays.
