Part 100. The prohibition on disability discrimination includes the requirement that new multifamily housing with four or more dwelling units—i.e., the public and common use areas and individual apartment units (all units in buildings with elevators and ground-floor units in buildings without elevators)—be designed and constructed with certain accessible features (See 24 C.F.R. § 100.201). Copyright All recipients must affix the applicable copyright notices of 17 U.S.C. §§ 401 or 402 and an acknowledgement of Government sponsorship (including award number) to any work first produced under Federal financial assistance awards. Debarment and Suspension All recipients are subject to the non-procurement debarment and suspension regulations implementing Executive Orders 12549 and 12689, and 2 C.F.R. Part 180. These regulations restrict awards, subawards, and contracts with certain parties that are debarred, suspended, or otherwise excluded from or ineligible for participation in federal assistance programs or activities. Drug-Free Workplace Regulations All recipients must comply with the Drug-Free Workplace Act of 1988 (41 U.S.C. § 701 et seq.), which requires all organizations receiving grants from any Federal agency agree to maintain a drug-free workplace. DHS has adopted the Act’s implementing regulations at 2 C.F.R Part 3001. Duplication of Benefits Any cost allocable to a particular Federal award provided for in 2 C.F.R. Part 200, Subpart E may not be charged to other Federal awards to overcome fund deficiencies, to avoid restrictions imposed by Federal statutes, regulations, or terms and conditions of the Federal awards, or for other reasons. However, this prohibition would not preclude a recipient form shifting costs that are allowable under two or more Federal awards in accordance with existing Federal statutes, regulations, or the terms and conditions of the Federal award. Education Amendments of 1972 (Equal Opportunity in Education Act) – Title IX All recipients must comply with the requirements of Title IX of the Education Amendments of 1972 (20 U.S.C. § 1681 et seq.), which provide that no person in the United States will, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any educational program or activity receiving Federal financial assistance. Part 100. The complainant alleged the District discriminated against her daughter on the basis of race by failing to take prompt and effective action to stop and address the racial harassment of her daughter by another student. The District voluntary agreed to resolve the complaint prior to the conclusion of OCR’s investigation into the complaint allegations. This Agreement does not constitute an admission by the District of a violation of Title VI or any other law. The District agrees to take the following actions:
Part 100. The compliance review assessed whether African-American students are provided equal educational opportunities to participate in the District’s Gifted and Talented Education (GATE) programs, honors and Advanced Placement (AP) courses in compliance with Title VI and its implementing regulation at 34 C.F.R. § 100.3. To resolve the compliance issues identified by OCR, and without admitting any violation of law, the District agrees to take the steps described in this Resolution Agreement (Agreement). Prior to entering into this Agreement, the District commenced initial work on effective measures to promote equitable identification of and participation by African-American and other students in GATE, honors, and advanced placement courses, including data review and analysis; review of identification and selection criteria and procedures; review of honors and AP prerequisites for consistency; providing staff more information regarding these program opportunities and procedures for inclusion; and a significant new effort to identify additional GATE students and to promote awareness by parents. Pursuant to this Agreement, the District agrees to take the following additional measures to further implement these efforts to ensure equal opportunities for all students.
Part 100. Prior to the completion of OCR’s investigation, the District agreed to resolve the issues of this investigation pursuant to Section 302 of OCR’s Case Processing Manual. Accordingly, to resolve the issues of this investigation, the District agrees to take the following actions.
Part 100. The District understands that OCR will not close the monitoring of this Agreement until OCR determines that the District has fulfilled the terms of the Agreement and is in compliance with the regulation implementing Title VI at 34 C.F.R. § 100.3, that was at issue in this case. The District also understands that by signing this Agreement, it agrees to provide data and other information in a timely manner in accordance with the reporting requirements of this Agreement. Further, the District understands that during the monitoring of this Agreement, if necessary, OCR may visit the District, interview staff and students, and request such additional reports or data as are necessary for OCR to determine whether the District has fulfilled the terms of this Agreement and is in compliance with the regulation implementing Title VI at 34 C.F.R. § 100.3 that was at issue in this case. The District agrees to take the following actions:

Part 100. The complainants alleged the District discriminated against their son (African American) and other African American/biracial students on the basis of race by creating or allowing a racially hostile environment to exist, specifically by permitting a District teacher to show a movie to third grade students about slavery that contained racial epithets, depicted violence against African Americans, and was not age appropriate, and permitting District teachers to conduct an exercise in which students acted out the role of slave children who were taken away from their parents.   • CFR PART 200 Procurement of Recovered Materials A non-Federal entity that is a state agency or agency of a political subdivision of a state and its contractors must comply with section 6002 of the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act. The requirements of Section 6002 include procuring only items designated in guidelines of the Environmental Protection Agency (EPA) at 40 CFR part 247 that contain the highest percentage of recovered materials practicable, consistent with maintaining a satisfactory level of competition, where the purchase price of the item exceeds $10,000 or the value of the quantity acquired during the preceding fiscal year exceeded $10,000; procuring solid waste management services in a manner that maximizes energy and resource recovery; and establishing an affirmative procurement program for procurement of recovered materials identified in the EPA guidelines.   • Transfer and Seniority Outside the Bargaining Unit (a) It is understood that an employee shall not be transferred by the Hospital to a position outside the bargaining unit without his consent except in the case of temporary assignments not exceeding six (6) months. Such employees on temporary assignments shall remain members of the bargaining unit. (b) An employee who is transferred to a position outside the bargaining unit shall not, subject to (c) below, accumulate seniority. In the event the employee is returned by the Hospital to a position in the bargaining unit within twenty-four (24) months of the transfer he or she shall be credited with the seniority held at the time of transfer and resume accumulation from the date of his or her return to the bargaining unit.
