PARTICIPANT'S RESPONSIBILITIES a. Participant warrants that Participant is both a licensed real estate broker and Participant of the (ASSOCIATION). b. Participant warrants that Agent possesses a real estate license and is in fact associated with Participant in an active effort to sell real estate or is a licensed or certified real estate appraiser affiliated with the ASSOCIATION Participant. c. Participant agrees to enforce the terms of the Agreement with respect to any Agent associated with him/her and understands that he/she is not relieved of any responsibility or obligation by the mere fact of such disassociation with Agent. d. Participant agrees to notify the ASSOCIATION immediately, in writing, should the Participant or Agent terminate their relationship or should the Agent's license be transferred. e. Participant agrees to take all responsible means to obtain Agent's Smart Card or cause Agent to return Smart Card to ASSOCIATION. The Participant will continue to be charged a service fee for the disassociated subscriber until the next billing cycle after the card is returned. If an Agent does not return the Smart Card, Participant agrees to furnish the ASSOCIATION with copies of written correspondence of all attempts made to obtain said Smart Card. f. Participant agrees that he/she is jointly and severally liable, together with the Agent, for all duties, responsibilities and undertakings of the Agent under this Agreement and understands that failure to follow the provisions of the SentriLock Smart Card User Agreement may result in the loss of ASSOCIATION Smart Card privileges and, further, could cause the ASSOCIATION to recall all Smart Cards issued to the Participant and the Participant's Agents.
PARTICIPANT'S RESPONSIBILITIES. At all times the Participants (to the extent applicable) are responsible for complying with the terms and conditions of the policies taken out under this Agreement and must ensure that their employees, Subcontractors and Subcontractors’ employees are made aware of, and comply with, those terms and conditions.
PARTICIPANT'S RESPONSIBILITIES. 3.1 The Participant agrees to the following: (i) Own/use 5G certified device; (ii) Use the unifi mobile 5G service as offered by TM; (iii) Complete the User Trial within the stipulated time frame; (iv) Permit/allow TM’s representative to terminate 5G service upon expiry of the User Trial Period; (v) Respond to survey, focus groups or testimonial engagement conducted by TM or its appointed agents on user’s experience during the User Trial; (vi) Permit TM to perform tests, experiments and measures relating to the Participant’s usage of the 5G service during the User Trial; (vii) Permit/allow TM’s personnel to visit Participant’s premise for observation whenever necessary; (viii) Ensure that the 5G service is for personal use only and not to be redistributed, re-sell or sub-let to third parties. In the event of such action or attempted action, this Agreement will be automatically terminated and the participation to this User Trial will be revoked immediately; (ix) Do not use the 5G service to design, create, develop or test other products without the express permission of TM. Any information obtained during the User Trial Period with regard to the 5G service shall legally be owned exclusively by TM or its authorised agents; (x) Follow TM’s instructions and/or guidelines with regard to the use of the 5G service; (xi) Continuously comply to all other existing terms and conditions for unifi Mobile (xxxxx://xxxxx.xxx.xx/mobile/postpaid/tnc) and be read together with this User Trail specific terms and conditions. In the event of inconsistency of terms, this specific terms will prevail. 3.2 During the Trial Period other and existing services including but not limited to SMS, call, mobile data (2G & 4G), roaming and direct carrier billing are enable at the same time and will be subject to the current publish rate of the respective service.
PARTICIPANT'S RESPONSIBILITIES. The Participant shall be responsible for ensuring that any direct rollover or transfer of assets from the Account pursuant to this Article 5.12 is a proper rollover or transfer of assets under the Code. The Custodian and/or Plan Administrator shall not be liable for any adverse tax consequences that may result to the Participant should any rollover or transfer duly authorized by the Participant be determined not to constitute a proper rollover or transfer under the Code.

Resending For Exhibits where Participant is sending Message Content to the Services, or using the Services to query to find Message Content, Participant shall resend, or make provisions to have resent, queries, Notices, and Message Content, as applicable, to the Services, which (i) Participant failed to successfully send to the Services, or (ii) Network failed to successfully send to a TDSO, upon Participant receiving a failure Notice from the Services so long as the Services does not send such failure Notice after having first acknowledged and accepted with no errors the message from Participant. In the event a query to find Message Content is no longer needed by the Participant, the retransmission may be done at Participant’s option. 8.1.2. Notices For Exhibits where Participant is sending Message Content to the Services, or using the Services to query to find Message Content, Participant shall, on a Transactional Basis, send any Notices received from the Services to the Authorized User that sent the query or Message Content (e.g., sending an acknowledgment of submission received from the Services). In cases where sending the Notices to the Authorized User’s system would cause undue harm, this requirement can be waived on a case by case basis and with written approval from Network. The specifications for the Notices and Message Content are set forth on the Network web site in the Use Case Implementation Guide for the applicable Exhibit.

PARTICIPANT'S RESPONSIBILITIES a. Participant warrants that Subscriber possesses a real estate license and is in fact associated with Participant in an active effort to sell/lease real estate or an employee of Participant properly licensed and/or qualified to perform the services contemplated herein. c. Participant agrees to enforce the terms of the Agreement with respect to any Subscriber associated with him/her and understands that he/she is not relieved of any responsibility or obligation by the mere fact of such disassociation with Subscriber. d. Participant agrees to notify the Multiple Listing Service of the Prescott Association of REALTORS® immediately, in writing, should the Participant or Subscriber terminate their relationship or should the Subscriber's license be transferred. e. Participant agrees to take all reasonable means to obtain Subscriber's XpressKEY device or cause Subscriber to return the XpressKEY device to the Multiple Listing Service of the Prescott Association of REALTORS®. The Participant will continue to be charged a service fee for the disassociated subscriber until the next billing cycle after the device is returned. If an Subscriber does not return the XpressKEY device, Participant agrees to furnish the Multiple Listing Service of the Prescott Association of REALTORS® with copies of written correspondence of all attempts made to obtain said XpressKEY device. f. Participant agrees that he/she is jointly and severally liable, together with the Subscriber, for all duties, responsibilities and undertakings of the Subscriber under this Agreement and understands that failure to follow the provisions of the Supra UTC Fire and Security User Agreement may result in the loss of Electronic Lockbox System privileges and, further, could cause the Multiple Listing Service of the Prescott Association of REALTORS® to revoke any or all Electronic Lockbox System access of the Participant and the Participant's Subscribers.
PARTICIPANT'S RESPONSIBILITIES. Participant acknowledges that it is his/her sole responsibility to report all contributions to or withdrawals from the Custodial Account correctly on his or her tax returns, and to keep necessary records of all the Participant IRAs (including any that may be held by another custodian or trustee) for tax purposes. All forms must be acceptable to the Custodian and dated and signed by the Participant.
PARTICIPANT'S RESPONSIBILITIES. The Customer must ensure that each Participant is made aware of the following requirements, and agrees to comply with the following: a) CTC Safety accepts no responsibility for damage or loss of any property left on its premises by Participants. b) CTC Safety recommends that Participants carry their personal valuables at all times, and CTC Safety will not be responsible for any loss or damage to a Participant’s personal valuables or property unless such property is damaged as a result of CTC Safety’ negligence. c) There is no provision for child minding at CTC Safety Courses and children are not permitted at any premises where Courses are conducted. d) Participants are required to report all injuries and incidents to CTC Safety’ Personnel immediately. e) Participants must turn off mobile phones during Courses. f) Where Participants are, in the reasonable opinion of the CTC Safety’ Personnel: i. being disruptive during the Course; ii. found to be cheating (collusion or plagiarism); iii. acting inappropriately towards, or harassing, CTC Safety employees or other Participants; CTC Safety will remove that Participant from the Course immediately, without a refund of the Fees.
