Pawn. Article 3.1 Details of the pawn are as per the List of Pledge. The List of Pledge is the appendix of this contact and has the same legal effect of this contract. Article 3.2 The effectiveness of the pledge under this contract shall be extended to the ancillary component, collateral rights, appendage, adjunction, natural and legal fruits, substitute of the pawn and such effectiveness shall also be extended to the insurance payment, compensation incurred from the damage, loss or confiscation of the pawn. Article 3.3 When the performance period of the principal debt expires, should the pawn be seized by the People’s court due to the non-performance of the principal debt, Party A shall be entitled to take the detached natural and legal fruits of the pawn. And the payment shall be in following sequence: A. Costs and expenses to collect the fruits B. Interest due and other costs and expenses under the principal contract C. Principal of the debt Article 3.4 The estimated value of pawn under the List of Pledge shall not be the foundation value when Party A disposes the pawn, and shall not limit the rights of Party A on executing the hypothecation. Article 3.5 The certificate of title of the pawn and related documents shall be sealed after mutual confirmation by both parties and shall be kept by Party A unless otherwise stipulated by the laws and regulations. Article 3.6 During the validation period of the contract, the pawn shall be possessed and employed by Party B. Party B shall maintain the pawn in good condition, and shall not employ the pawn in any inappropriate way, which will tear off the value of pawn. Party A reserves the right to check the condition of the pawn. Article 3.7 Should there be any damage, loss to the pawn, Party B shall inform Party A in time and take measures to prevent the aggravation of the loss or damage. Party B is also obliged to provide the certificate issued by the competent authorities to testify such damage or loss at the same time. Article 3.8 In case the action of Party B will sufficiently result in the reduction of pawn value, Party B is obliged to suspend its action immediately. If the pawn value is reduced as thus, Party B shall recoup the value of pawn or provide guarantee with equivalent value. Article 3.9 In case Party B is immune from the reduction of pawn value, the compensation and reimbursement to Party B shall be used to refund the debts under the principal contract in advance, or to recoup the value of pawn with the c...
Pawn. 37.5.1 All arrangements relating to the granting of Loans supported by pawn comply in all respects with the requirements of the CCA and all other appropriate legislation including the limitation in relation to the form of pawn receipt to be utilised for Pledge Stocks, the form of notice of intention to sell for unredeemed items and the form of written advice given to customers where non-redeemed Pledge Stocks have been sold. 37.5.2 No items of Pledge Stocks are held other than on terms set out in the appropriate Pawn Agreement. 37.5.3 The Company's processes in relation to the Pledge Stocks where a Loan is not repaid relating to the realisation of the relevant Pledge Stocks are as set out in disclosure 37.5.3 of the Disclosure Letter and these are the processes that have been followed in all cases where Pledge Stocks have been realised and/or sold by the Company. 37.5.4 The Company has not received any complaints or allegation that its processes for instigating the sale and then selling any Pledge Stock are unlawful, unfair or inappropriate. 37.5.5 The Company has no current, and during the last two years, has had no material litigation or, so far as the Vendor is aware, disputes relating to its entitlement to hold the Pledge Stocks or the money realised on sale of any Pledge Stocks.

  • Footwear Where an employee is required by the College or by legislation, in order to perform his/her duties, to acquire and wear protective footwear, the employee shall provide the College with proof of purchase by March 1 each year and the College shall reimburse such employee, on the first pay day in April in each year, up to a maximum of one hundred and fifty dollar ($150.00). In situations other than the foregoing, the College may, in its discretion, (which discretion shall not be unreasonably exercised) reimburse such expense where it is recommended by the health and safety committee constituted under the Occupational Health and Safety Act.

  • Games The Private Party shall not be entitled to introduce any arcade type amusement or gaming machines into the Restaurant Facility without the prior written approval of SANParks.

  • Alcoholic Beverages Costs of alcoholic beverages are unallowable.

  • Cards 2.1 The Card is a prepaid payment card which may be used to pay for goods and services at participating retailers that accept prepaid Visa cards. The physical card may be used in shops and retail locations where the Cardholder is physically present or for online and other distance purchases. Your Card cannot be used to make cash withdrawals from ATMs and banks. Like any Card, We cannot guarantee that a particular retailer will accept the Card – Cardholders should check with the retailer before attempting the transaction if unsure. The Cardholder will not be able to use the Card to make any purchases from some retailers; such retailers have been blocked by Our systems in order to prevent the potential use of cards for unauthorised or unlawful activity. 2.2 The Card is an electronic money (“e-money”) product, regulated by the Financial Services Commission (“FSC”), Gibraltar. It is a prepaid card not a credit card and is not linked to Your bank account. You must ensure that You have sufficient Available Funds in the Master Wallet for the Cardholder to pay for each purchase or payment using the Card. The Card is intended for use as a means of payment, and funds loaded onto the Card do not constitute a deposit. You will not earn interest on the balance of the Card. The Card will expire on the Expiry Date and will cease to work. Please check clause 8 of this Agreement for further information. 2.3 The electronic money associated with the Card is issued by IDTFS to You. 2.4 When the Cardholder receives the Card, it will be issued in an inactive state. The Cardholder will need to activate it by logging onto Our Website, in Your personal login area (“Online Account Centre”) and then following the login and activation request for the Card prior to use. The Card will normally be ready for use one hour after activation. If the Cardholder does not activate the Card, any transactions that the Cardholder attempts to carry out may be declined.

  • Catering Cafeteria style of serving meals will be acceptable, providing dishes are carried back by the Culinary Staff. The food shall be of good quality and have the approval of the Camp Committee of the Building and Construction Trades Council of Ontario. There shall be sufficient housekeeping staff supplied by the Culinary Workers to keep the bunkhouses clean, and beds shall be made up each day by such staff. Kitchen facilities, equipment and food supplies shall be subject to inspection by the duly authorized Camp Committee at any and all times and further all grievances shall be dealt with by said Committee.

  • Coaches (a) Seat rotation: To ensure all passengers have the opportunity to enjoy front and window seats, a daily seat rotation system is employed on all of Our coaches and You must follow the seat rotation system. (b) Travel sickness: If You suffer from travel sickness, You should arrange medication or other alternatives to treat symptoms, as We cannot make allowances for this.
