Pay for Court Appearances. In the event that an employee is required by subpoena or specifically assigned by supervisory or command personnel to appear to testify in court outside the employee's regularly scheduled work hours, the employee shall be paid at the rate of one and one half times (1½) his/her regular rate of pay for the actual time in court with a minimum pay equivalent for three (3) hours.

Pay for Court Appearances. The City agrees to pay any employees who have been in the continuous employ of the City for thirty (30) calendar days or more, and who are requested to appear as a witness in any job-related deposition, administrative proceeding or court case by subpoena (no subpoena is required if the request to the employee is made by the City Attorney), during the time they are required to be absent from their jobs, their straight time rate (excluding premiums or overtime) for the actual time necessarily required for such deposition, administrative proceeding or court case, less the compensation paid them for witness fees. This pay provision does not apply to employees who are requested to appear as a witness in any deposition, administrative proceeding or court case in which the employee, or a family member of the employee, is a party who has an interest which is adverse to that of the City or its subunits. In these instances, the employee shall request leave from his or her supervisor or department head, who shall not unreasonably deny a request for such leave.
Pay for Court Appearances. An Employee required by his/her employment to appear in Civil Court, Juvenile Court or Superior Court or at a Motor Vehicle Hearing on his/her regularly scheduled off-duty time shall be paid at the rate of one and one-half (1½) times his/her regular straight-time hourly rate for each such hour or part thereof, but in no event, for less than four (4) hours on each such day. The rate of time and one-half (1½) shall include any payment from the State of Connecticut or from any other agency or party; i.e. the Town pays the difference to make up the time and one-half (1½). Billing for Civil Court appearances shall be handled by the Town.

  • Court Approval This Agreement is subject to approval of the courts with respect to participating carriers in the hands of receivers or trustees.

However, reduction in salary will not be made for an FLSA-exempt employee to testify in court or at a deposition except for full workweek increments where such testimony causes an absence of one (1) or more full workweeks.
