Common use of Personal/Carer’s Leave Clause in Contracts

Personal/Carer’s Leave. a) Personal/carer’s leave is defined in accordance with Section 244 of the Act and includes paid sick leave (accrued under the AFPCS) and paid or unpaid carer’s leave (accrued under the AFPCS). Casual employees shall have no entitlement to paid personal/carer’s leave. b) An employee(s) entitlement to personal/carer’s leave under this Agreement shall, from the date of lodgement of this Agreement, be in accordance with the AFPCS. c) Payment for paid personal/carer’s leave shall be in accordance with Section 247 of the Act, being payment to the employee of what the employee would have reasonably expected to be paid if the employee had worked during that period of personal/carer’s leave. d) An employee, other than a casual employee, shall be entitled to paid personal carer’s leave of 1/26th of their nominal hours worked per annum, i.e. ten (10) days per year. e) An employees entitlement to paid personal carer’s leave shall accrue and be credited each month on a pro-rata basis of nominal hours worked or paid in accordance with the AFPCS.
