Personal Leave Days. Section 1. All permanent full-time employees will be eligible for paid personal leave days as follows: a. One paid personal leave day will be earned in the employee's first calendar year of employment provided the employee has 150 hours (37.5 hour work week) or 160 hours (40 hour work week) in an active pay status in the calendar year. b. One paid personal leave day per one-half calendar year will be earned in the employee's second calendar year of employment, provided the employee has 150 hours (37.5 hour work week) or 160 hours (40 hour work week) in an active pay status in each one-half calendar year. c. Section 2. Personal leave shall be scheduled and granted for periods of time requested by the employee subject to management's responsibility to maintain efficient operations. If the nature of the work makes it necessary to limit the number of employees on personal leave at the same time, the employee with the greatest seniority as defined in Article 24, Section 1 shall be given a choice of personal leave in the event of any conflict in selection. Section 3. Personal leave days shall be non-cumulative from calendar year to calendar year. However, employees will be permitted to carry over personal leave days into the first seven (7) pay periods of the next calendar year. Any days carried over in accordance with this Section which are not scheduled and used during the first seven (7) pay periods of the next calendar year will be lost. Section 4. An employee who becomes ill while on personal leave will not be charged personal leave for the period of illness provided the employee furnishes satisfactory proof of such illness to the Employer upon return to work. Section 5. All permanent, part-time employees shall receive personal leave days on a pro-rata basis calculated to the nearest half day, provided they are in an active pay status a percentage of 150 hours (37.5 hour work week) or 160 hours (40 hour work week) equal to the percentage of hours normally worked in a biweekly pay period during the earning periods specified in Section 1 above. Section 6. Effective as soon as practically and legally possible, the Commonwealth will adopt a tax-qualified Leave Payout Plan. All employees who attain age 55 before or during the calendar year they separate from service after adoption of the Leave Payout Plan shall have the leave payouts otherwise payable for accumulated and unused Annual Leave, Personal Leave, Compensatory Leave, Holiday Leave and Sick Leave, up to the maximum allowable by law, deposited in an account in the employee’s name, provided however that if the total amount of leave payout is $5000 or less, this amount shall be paid to the employee in cash. Amounts in excess of the maximum allowable amount will be paid to the employee in cash. Section 7. An employee who terminates employment for any reason shall be compensated for any personal days which the employee has earned but not used. Section 8. For the purpose of this Article, the calendar year shall be defined as beginning with the employee's first full pay period commencing on or after January 1, and continuing through the end of the employee's pay period that includes December 31. For the purpose of this Article, the calendar quarters shall be defined as beginning with the first full pay period in January through March 31, April 1 through June 30, July 1 through September 30, and October 1 through the last full pay period of the leave calendar year, which is the pay period that includes December 31. Section 9. Effective with the beginning of the 2017 leave calendar year and the incorporation of personal leave into annual leave, this Article shall expire. An additional personal day earned by an employee under the provisions of Article 9, Section 14 based on no sick leave usage during leave calendar year 2016 will be converted to an additional annual leave day at the beginning of the 2017 leave calendar year and thereafter be available for use in accordance this Article.

Section 9. An employee's request for a personal leave day on the employee's birthday received in writing at least 45 calendar days prior to the employee's birthday shall be approved. An employee shall be allowed to anticipate the earning requirement in Section 1 above for a personal leave day used on the employee's birthday. If an employee's birthday falls on a day other than a regularly scheduled workday, the employee will be permitted to schedule a personal leave day in accordance with this Section either the work day immediately before or after the birthday. Section 10. Effective with the beginning of the 2017 2018 leave calendar year and the incorporation of personal leave into annual leave, this Article shall expire. An additional personal day earned by an employee under the provisions of Article 98, Section 14 11.a. based on no sick leave usage during leave calendar year 2016 2017 will be converted to an additional annual leave day at the beginning of the 2017 2018 leave calendar year and thereafter be available for use in accordance this Article.

Personal Leave Days. Section 1A. There shall be twenty-four (24) personal leave hours per each calendar year, commencing on January 1st and ending on December 31st, granted to members of AFSCME, Local 1562, Council 8. All permanent Part-time bus operators and part-time laborers shall have eight (8) personal leave hours per calendar year, commencing on January 1st and ending December 31st. Part-time bus operators and part-time laborers who turn full-time may not receive more than twenty-four (24) personal leave hours in the calendar year outlined above. The leave hours request shall be made at the commencement of each shift period by request to the employee’s supervisor. The supervisor shall grant the leave hours as requested unless operational requirements necessitate the presence of the employee. In the event of any employee emergency, it is not necessary to report the request at the beginning of the shift if said emergency is incurred during the shift. The employee’s supervisor shall be responsible for keeping a personal leave day record for the calendar year for each employee with date and hour leave indicated and initialed by the supervisor and the employee. Normally there shall be no carry-over of unused personal leave hours. However, if an employee is unable to take personal leave due to a denial due to operational reasons the employee can roll over that personal day (hours) to be scheduled and utilized no later than March 1 of the subsequent year or shall be paid for said unused leave, at the discretion of the employee. The leave hours may be taken in any amount, but not less than fifteen (15) minutes for each period. B. New employees hired on or before March 31st shall be eligible for twenty-four (24) hours of personal leave. New employees hired between April 1st and June 30th shall be eligible for sixteen (16) hours of personal leave. New employees hired between July 1st and September 30 shall be eligible for eight (8) hours of personal leave. New employees hired between October 1st and December 31st shall not be eligible for personal leave for that calendar year. C. Part-time employees who become full-time employees will be eligible for paid receive a prorated full-time equivalent amount of personal leave days as follows: a. Leave entitlement under this Section shall be exclusive of "on call" time. Section 67. Section 2. Personal leave shall be scheduled and granted for periods of time requested by the employee a Supervisor subject to management's responsibility to maintain efficient operations. If the nature of the work makes it necessary to limit the number of employees Supervisors on personal leave at the same time, the employee Supervisor with the greatest seniority as defined in Article 24, Section 1 shall be given a choice of personal leave in the event of any conflict in selection. Section 3. Personal leave to which a Supervisor may become entitled during the calendar year may be granted at the Employer's discretion before it is earned. A Supervisor who is permitted to anticipate such leave and who subsequently terminates employment shall reimburse the Employer for those days of personal leave used but not earned. Section 4. The Employer will continue its present practice of granting administrative leave to a reasonable number of Supervisors who attend training seminars conducted by the Union to the same general extent that this has been granted in prior years. Section 5. Supervisors shall be granted up to four (4) hours of administrative leave per calendar year to donate blood. Section 6. For the purpose of this Recommendation, the calendar year shall be defined as beginning with the beginning Supervisor’s first full pay period commencing on or after January 1 and continuing through the end of the 2017 leave calendar year and the incorporation of personal leave into annual leave, this Article shall expire. The written request for personal leave may be denied if requests are in excess of ten percent (10%) of the staff of each employee classification for any specific date. However, in the period case of illness provided the employee furnishes satisfactory proof Transportation Department, requests may be denied if they are in excess of such illness to two (2) persons or five percent (5%) of the Employer upon return to workdepartment staff for any specific date, whichever is greater. Section 5. All permanentD. Provided the provisions of this Article are met and not otherwise scheduled to work or report for professional development, part-time employees shall receive transportation employees, aides, and food service workers may request to utilize personal leave days on teacher in-service days during the school year. E. Personal leave days may be taken immediately preceding or immediately following scheduled holidays at the discretion of the immediate supervisor. F. Whenever a day of personal leave has been approved and a substitute employed for such position, the obligation to the substitute must be recognized. If the employee wishes to report for work, his/her supervisor must be notified twenty-four (24) hours in advance or otherwise the employee shall be paid the difference between his/her daily compensation and the substitute’s rate. G. An employee in active service for less than a full anticipated work year will have their personal leave reduced on a pro-rata basis calculated rated basis. The District reserves the right to recoup any overpayment of leave due to the nearest half day, provided they are in an active pay status reduction of days on a percentage of 150 hours (37.5 hour work week) or 160 hours (40 hour work week) equal to the percentage of hours normally worked in a biweekly pay period during the earning periods specified in Section 1 abovepro- rated basis. Section 6. Effective as soon as practically and legally possible, the Commonwealth will adopt a tax-qualified Leave Payout Plan. All employees who attain age 55 before or during the calendar year they separate from service after adoption of the Leave Payout Plan shall have the leave payouts otherwise payable for accumulated and unused Annual Leave, Personal Leave, Compensatory Leave, Holiday Leave and Sick Leave, up to the maximum allowable by law, deposited in an account in the employee’s name, provided however that if the total amount of leave payout is $5000 or less, this amount shall be paid to the employee in cash. Amounts in excess of the maximum allowable amount will be paid to the employee in cash. Section 7. An employee who terminates employment for any reason shall be compensated for any personal days which the employee has earned but not used. Section 8. For the purpose of this Article, the calendar year shall be defined as beginning with the employee's first full pay period commencing on or after January 1, and continuing through the end of the employee's pay period that includes December 31. For the purpose of this Article, the calendar quarters shall be defined as beginning with the first full pay period in January through March 31, April 1 through June 30, July 1 through September 30, and October 1 through the last full pay period of the leave calendar year, which is the pay period that includes December 31. Section 9. Effective with the beginning of the 2017 leave calendar year and the incorporation of personal leave into annual leave, this Article shall expire. An additional personal day earned by an employee under the provisions of Article 9, Section 14 based on no sick leave usage during leave calendar year 2016 will be converted to an additional annual leave day at the beginning of the 2017 leave calendar year and thereafter be available for use in accordance this Article.

Personal Leave Days. Section 1. All permanent full-time employees will be eligible for paid personal leave days as follows: a. Section 2. Personal leave shall be scheduled and granted for periods of time requested by the employee subject to management's responsibility to maintain efficient operations. If the nature of the work makes it necessary to limit the number of employees on personal leave at the same time, the employee with the greatest seniority as defined in Article 24, Section 1 shall be given a choice of personal leave in the event of any conflict in selection.the Section 3. Personal leave to which an employee may become entitled during the calendar year may be granted at the Employer's discretion before it is earned. An employee who is permitted to anticipate such leave and who subsequently terminates employment shall reimburse the Employer for those days of personal leave used but not earned. Section 4. Personal leave days shall be non-cumulative noncumulative from calendar year to calendar year. However, employees will be permitted to carry over personal leave days into the first seven (7) pay periods of the next calendar year. Any days carried over in accordance with this Section which are not scheduled and used during the first seven (7) pay periods of the next calendar year will be lost. Section 45.
