PHASED IDENTIFICATION AND EVALUATION OF HISTORIC PROPERTIES. A. IDENTIFICATION As TVA develops the details of the Undertaking, TVA will consider further the possible effects of the Undertaking on eligible and potentially eligible properties within the APE. The APE will remain as shown in Appendix B unless TVA determines, in consultation with the TN SHPO, that final project plans warrant revising the APE in order to better delineate the area in which there is potential for effects on historic properties. Should the APE be revised by TVA in consultation with TN SHPO, TVA shall take any additional steps necessary to identify historic properties within the revised APE, and this may include one or more additional Phase I identification surveys. Said surveys shall be carried out in a manner consistent with the Secretary of the Interior’s Standards and Guidelines for Identification (48 FR 44720-23) and the Tennessee Historic Commission, Review and Compliance Section, Reporting Standards: Archaeological and Architectural Resource Identification Studies (Survey Reports). TVA shall submit draft and final Survey Reports to TN SHPO and the Signatories for comment within a thirty (30) day period, pursuant to 36 CFR § 800.4(d). If project plans include activities that would disturb soils or sediments to depths greater than the maximum depth investigated previously during the archaeological surveys of the APE (approximately 80 cm or 31 in), in areas with potential for deeply buried cultural deposits, the APE will be enlarged in the vertical dimension, within areas with potential for deeply buried deposits (see Appendix D), to include deposits not previously investigated that could be affected by the Undertaking. Such testing will be carried out in the manner described in the preceding paragraph.

PHASED IDENTIFICATION AND EVALUATION OF HISTORIC PROPERTIES. A. BOEM will implement the following consultation steps for phased identification of historic properties in accordance with BOEM’s Guidelines for Providing Archaeological and Historic Property Information Pursuant to Title 30 Code of Federal Regulations Part 585. The final identification of historic properties related to the Terrestrial APE may occur after publication of the Draft EIS, but prior to the initiation of construction. BOEM will conduct phased identification of historic properties, pursuant to 36 CFR § 800.4(b)(2) and following the steps below: 1. Dominion Energy will complete Phase IB archaeological resource identification in the remainder of the terrestrial APE parcels in the final preferred cable routes not previously investigated in archaeologically sensitive areas. The Phase IB surveys will proceed under the current Terrestrial Archaeology Survey Plan previously submitted to VDHR and BOEM. 2. If archaeological sites that exhibit potential for listing in the NRHP are identified during phased terrestrial site identification for onshore components of the Project, then additional site-specific evaluation and mitigation may be warranted. 3. For identification of historic properties within the APE, supplemental technical studies will be conducted by Dominion Energy in accordance with state guidelines and recommendations presented in BOEM’s most recent Guidelines. The developer will coordinate with the SHPO prior to the initiation of any such identification efforts. 4. BOEM will consult on the results of historic property identification surveys for any portions of the APE that were not previously addressed. 5. If effects on identified resources cannot be avoided, BOEM will evaluate the NRHP eligibility of the potentially affected properties, in accordance with 36 CFR § 800.4(c). 6. If XXXX identifies no additional historic properties or determines that no historic properties are adversely affected, BOEM, with the assistance of Dominion Energy, will notify and consult with the signatories, invited signatories, and consulting parties following the consultation process set forth here in this stipulation. i. Dominion Energy will notify all the signatories, invited signatories, and consulting parties about BOEM’s determination by providing a written summary of the alternative including any maps, a summary of the surveys and/or research conducted to identify historic properties and assess effects, and copies of the surveys. ii.
