Placement on Reemployment List. When all available leaves of absence, paid or 32 unpaid, have been exhausted and if the employee is not medically able to assume the 33 duties of his/her position, he/she shall, if not placed in another position, be placed on 34 a reemployment list for a period of thirty-nine (39) months. When cleared to return 35 to work, during the thirty-nine (39) month period, he/she shall be employed in a 36 vacant position in the classification of his/her previous assignment over all available 37 candidates, except for a reemployment list established because of lack of work or 38 lack of funds, in which case he/she shall be listed in accordance with appropriate 39 seniority requirements. If an employee's former classification has ceased to exist 40 during his/her absence, the employee shall be assigned to a vacant position in a 41 comparable classification for which qualified. An employee who has been placed on 42 such a reemployment list and who has been released for return to duty and who fails 43 to accept a position in his/her classification shall be subject to dismissal. 44

Placement on Reemployment List. ‌ 1. When all available leaves of absence, paid or unpaid, have been exhausted and if a permanent employee is not medically able to assume the duties of their previous position, the permanent employee shall, if not placed in another position, be placed on a reemployment list for a period thirty-nine (39) months.‌ 2. When available during the thirty-nine (39) month period, the person shall be employed in a vacant position in the class of the person’s previous assignment over all other available candidates, except for a reemployment list established because of lack of work or lack of funds, in which case the person shall be listed in accordance with appropriate seniority regulations.‌ 3. An employee who has been placed on a reemployment list, as provided herein, who has been medically released for return to duty and who fails to accept an appropriate assignment shall be dismissed.‌
Placement on Reemployment List. The names of employees laid off shall be placed on a reemployment list in the reverse order of layoff. All employees laid off shall be placed on the reemployment list for not less than thirty-nine (39) months. Employees accepting demotion or voluntary reduction in assigned time in lieu of layoff shall be placed on the reemployment list for a total of sixty-three (63) months. Employees who take voluntary reduction in assigned time in lieu of layoff shall be, at the employee’s option, returned to a position in his/her former class or to positions with increased assigned time as vacancies become available within the sixty-three (63) months. All such employees shall be ranked on the reemployment list in accordance with their seniority.

  • Discussions Before Termination (a) Where an employer has made a definite decision that the employer no longer wishes the job the employee has been doing done by anyone and this is not due to the ordinary and customary turnover of labour and that decision may lead to termination of employment, the employer shall hold discussions with the employees directly affected and with his/her union, where applicable. (b) The discussion shall take place as soon as is practicable after the employer has made a definite decision which will invoke the provisions of paragraph (a) of this subclause and shall cover among other things, any reasons for the proposed terminations, measures to avoid or minimise the terminations and measures to minimise any adverse affect of any terminations on the employees concerned. The employer will confirm the content of these discussions in writing.

  • Approved Leave of Absence With Pay During Vacation When an employee is qualified for bereavement leave, sick leave or any other approved leave with pay during her vacation period, there shall be no deduction from the vacation credits for such leave. In the case of sick leave, this section shall only apply when the period of illness or injury is in excess of two (2) days and a note from a physician may be required. The period of vacation so displaced shall be taken at a mutually agreed time. An employee intending to claim displaced vacation leave must advise the Employer and provide necessary documentation within seven (7) days of returning to work.
