Plans and Specifications Approval. The City Staff shall review plans and specifications for all construction proposed by the Owner within the District and either will approve such plans and specifications within thirty (30) days of the date of submission or will indicate in writing any deficiencies found in such plans or specifications within such 30-day period. The City Staff shall note and reject plans and specifications with deficiencies including (i) plans for a project that is not included in the Plan or (ii) plans not designed in accordance with City or other applicable regulations or sound professional practices. The Owner shall correct any deficiencies identified by the City Staff, and after re- submittal plans and specifications shall either be approved or noted for deficiencies within an additional fifteen (15)-day period, and additional 15-day periods shall apply for subsequent reviews of plans and specifications found by the City still to be deficient. If the City fails to act on a set of plans and specifications within the original 30-day period, then such plans and specifications shall be deemed to be approved by the City. For purposes of this Section 3.3, submittal is deemed to occur when the City receives plans and specifications for a particular portion or component of the Project. The City shall designate a particular member of the City Staff (and an alternate) to receive all copies of such plans and specifications. Notwithstanding the foregoing, should City Staff determine that any approval to be given under this Section 3.3 (i) requires the approval of Council or any governmental entity or agency other than the City, and (ii) such approval cannot or will not be obtained within the time limitations imposed by this Section 3.3, then City Staff shall request from the Owner an extension of such time limitations; and approval of such request shall not be unreasonably withheld.

Plans and Specifications Approval. Upon execution of the Lease, Tenant shall furnish to Landlord and the Architect preliminary space plans for the construction of the Work which the Architect shall use to prepare and submit to Landlord within the next N/A (___) days the proposed plans and specifications for the Work. Landlord shall thereafter have N/A (___) days within which to approve the proposed plans and specifications or disapprove, in which event, Landlord shall advise Tenant and the Architect, in writing, of the reasons for its disapproval. The Architect shall have N/A (___) days from the date of written disapproval from Landlord to make the adjustments required by Landlord, and resubmit the revised plans and specifications to Landlord and Tenant. Thereafter, Landlord shall again have N/A (___) days to approve or disapprove the revised plans and specifications. If Tenant fails to submit the preliminary space plans on a timely basis, it shall constitute a Tenant Delay. The approval of the Plans and Specifications by Landlord shall not be construed as any representation or warranty by Landlord with respect to the accuracy of the Plans and Specifications or their compliance with applicable laws, including, without limitation, compliance with the Americans With Disabilities Act, for which it shall be the sole responsibility of the Tenant to insure the Premises are in compliance therewith.
Plans and Specifications Approval. Subsequent to the execution of the Lease, Landlord shall furnish to Tenant (I) copies of preliminary plans and specifications for the Building Shell Improvements and elevations of the storefront and (ii) a detailed site plan (the "Site Plan") of the Shopping Center showing the location, configuration and size of the Premises and other buildings, the layout of the parking areas, including number of parking spaces, drives and parking aisles, traffic lanes and direction of traffic, the location of entrances, curbs and curb cuts, pylon or monument signs and Common Areas in the Shopping Center. Tenant shall have furnished to Landlord Tenant's prototypical plans and specifications and floor plans for the Leasehold Improvements (the "Prototypical Plans"). Landlord shall submit to the Project Architect and the Project Architect shall prepare and submit to both Landlord and Tenant, proposed plans and specifications for the Building Shell Improvements and the Leasehold Improvements within _____ (__) days of Landlord's receipt of the Prototypical Plans. Landlord and Tenant shall thereafter have ten (10) days within which to approve or disapprove the proposed plans and specifications in writing. Any disapproval shall be accompanied by a detailed list specifying the points of disapproval and the changes which would satisfy such points. Such approval or disapproval shall be in writing directed to the Project Architect with a copy to the other party. The Project Architect (and Consulting Architect) shall have ten (10) days from the date of written disapproval to discuss such points of disapproval with both parties, make adjustments to the proposed plans and specifications, and resubmit revised proposed plans and specifications to both parties. Thereafter, Landlord and Tenant shall again have ten (10) days to approve or disapprove the proposed plans and specifications. This procedure shall be repeated until Landlord and Tenant have mutually agreed on the proposed plans and specifications. Each party shall acknowledge its approval by signing and delivering to the other party a set of such approved plans and specifications or a letter identifying the approved plans and specifications. The approved plans and specifications for the Building Shell Improvements and the Leasehold Improvements shall constitute the "Final Plans" for all purposes under this Lease.   • Plans and Specifications After Landlord receives and approves Tenant’s Space Plan as provided above, Tenant will cause Tenant’s Architect to prepare the Plans and Specifications for the Tenant Improvements. Landlord will approve or disapprove (specifically describing any reasons for disapproval) the Plans and Specifications in writing within ten (10) Business Days after receiving them. If Landlord disapproves the Plans and Specifications, Tenant will provide appropriately revised Plans and Specifications to Landlord for approval (or disapproval) within five (5) Business Days on the same basis as set forth above. After Landlord’s approval, Tenant will submit the Plans and Specifications for permits and construction bids. No deviation from the Building Standard will be permitted in the Space Plan or the Plans and Specifications, provided reasonable deviations with respect to the ceiling, lighting, painting, flooring and wall covering may be permitted with Landlord’s approval. Landlord will not approve any deviations which Landlord believes (a) do not conform to applicable codes, ordinances and other Laws or are disapproved by any governmental agency, (b) require services beyond the level normally provided to other tenants in the Building, or (c) are of a nature or quality that are inconsistent with Landlord’s overall plan or objectives for the Building. No approval by Landlord of any deviation constitutes an acknowledgment by Landlord that such deviations are in conformance with applicable codes, ordinances and other Laws. In the event that Landlord’s approval shall be required in this Tenant Improvements Agreement, then notwithstanding anything to the contrary set forth in the Lease, Landlord’s approval shall not be unreasonably withheld, conditioned, or delayed.
