Priority of Contract Documents. Except if and the extent otherwise provided by the Contract, the provisions of the General Conditions of Contract and Special Conditions shall prevail over those of any other documents forming part of the CONTRACT. Several documents forming the CONTRACT are to be taken as mutually explanatory of one another, but in case of ambiguities or discrepancies the same shall be explained and adjusted by the ENGINEER-IN-CHARGE who shall thereupon issue to the Contractor instructions thereon and in such event, unless otherwise provided in the Contract, the priority of the documents forming the Contract shall be as follows :

Priority of Contract Documents. This Contract shall include the following Annexes, which form an integral part hereof and which shall take precedence over one another in case of conflict in the following order: Annex C: GGGI General Conditions of Contract Annex A: Technical Component Terms of Reference Time Table and Reporting Parts A-D Annex B: Financial Component In the event that the terms contained in the Annexes are incompatible with those contained in the main body of the Contract, then the terms contained in the main body of the Contract shall govern and prevail. [For the avoidance of any doubt, the Special Conditions specified in Article 8 below are deemed incorporated into the Annex C General Conditions of Contract and have the order of precedence designated for Annex C.

Priority of Contract Documents. This Protocol forms part of this Agreement. In the event of a conflict or inconsistency between the terms of this Protocol and any other documents contained in and/or forming part of this Agreement, except where the Protocol states otherwise, the terms of this Protocol shall prevail. The Performance Security shall be in the form of a bank guarantee as stipulated by the Employer in the Appendix to Bid. The Performance Security shall be issued by a bank incorporated in Kenya. The Contractor shall notify the Engineer when providing the Performance Security to the Employer. “Without limitation to the provisions of the preceding paragraph, whenever the Engineer determines an addition to the Contract Price as a result of a change in cost, the Contractor, at the Engineers written request, shall promptly increase the value of the Performance Security by an equal percentage.
