PRIVACY CLAUSE. 53.1 The Organisation and/or Cardholder confirms that he/she has read, understood and agreed to be bound by BSN Privacy Notice (which is available at xxx.xxxxx.xxx.xx) and the clauses herein, as may relate to the processing of the Cardholder’s personal information. For the avoidance of doubt, the Organisation and/or Cardholder agree that the said Privacy Notice shall be deemed to be incorporated by reference into this Agreement.
53.2 In the event the Organisation and/or Cardholder provides personal and financial information relating to third parties, including information relating to the Cardholder’s next-of-kin and dependents (where the Cardholder is an individual) or information relating to the Organisation and/or Cardholder’s directors, shareholders, officers, individual guarantors and security providers (where the Cardholder is a corporation), for the purpose of opening or operating the Organisation’s account(s)/facility(ies) with BSN or otherwise subscribing to the BSN’s Products and Services, the Cardholder:-
(a) confirms that he/she has obtained their consent or are otherwise entitled to provide this information to BSN and for BSN to use it in accordance with this agreement;
(b) agrees to ensure that the personal and financial information of the said third parties is accurate;
(c) agrees to update BSN in writing in the event of any material change to the said personal and financial information; and
(d) agrees to the BSN’s right to terminate this Agreement should such consent be withdrawn by any of the said third parties.
53.3 Where the Organisation and/or Cardholder instructs BSN to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by overseas regulators and authorities in connection with their legitimate duties (e.g. the prevention of crime). In instructing BSN and/or the BSN’s agents to enter into any cross-border transaction on the Organisation and/or Cardholder’s behalf, the Organisation and/or Cardholder agree to the above said disclosures on behalf of the Organisation and/or Cardholder and others involved in the said cross-border transaction.

PRIVACY CLAUSE. The Contractor shall, at all times, maintain confidential all information pertaining to any person, patient, or client with whom it has a professional relationship, contact or contract. No information shall be released to any person or party not directly employed by the Contractor without first obtaining such person's, patient's or client's expressed written consent therefore. Confidential information pertaining to any minor shall not be released to any person or party without the express written consent of a custodial parent, court appointed guardian, court authorized xxxxxx parent, or authorized self- consenting minor, subject however, to all applicable state and federal statues, rules and regulations.

14.3 Where you instruct the Bank to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by overseas regulators and authorities (e.g. for the prevention of crime). PRIVACY CLAUSE. 23.1. The Lender shall treat the Borrower’s personal information / data as private and confidential. Nothing about the Borrower’s accounts nor name and address will be disclosed to anyone other than in the following exceptional circumstances:
23.1.1. where the Lender is legally compelled to do so, e.g.: Credit Reference Bureau
23.1.2. where it is in the public interest to disclose such information
23.1.3. where the Lender’s interests require disclosure, e.g.: Employees, Bank and Insurance
23.1.4. where disclosure is made at the Borrower’s request or with the Borrower’s written consent;
23.1.5. where disclosure to any third party by the Lender is necessary to enforce collection or recovery of payments due to the Lender in terms of this Agreement;
23.1.6. where disclosure to any third party by the Lender is necessary to enforce collection or recovery of the Outstanding Loan Balance of each relevant Loan upon the occurrence of an event of default (as defined in clause 15.3) by the Borrower and/or termination of this Agreement; and
23.1.7. where disclosure to any third party is necessary to enable the Lender to vet the Borrower in terms of credit-worthiness in order to give the Lender comfort to proceed with execution of this Agreement or any Further Loan Application Form.
23.2. The Borrower hereby acknowledges and agrees that the Lender may, for the purposes identified in clause 23.1.1 to 23.1.7 above, process the information / data regarding the Borrower, including without limitation, the Borrower’s personal information.
23.3. Processing of information / data by the Lender as referred to above shall mean, without limitation, any action in connection with the information / data, in particular, the collection, acquisition, recording, audio recording, video recording, organising, storage, alteration, restoration, revocation, use, disclosure, transfer, blocking, combination, destruction, dissemination of the information / data received from the Borrower and/or any other third person(s) Remotely or in writing.
23.4. Data processing by the Lender through Remote Channels shall also include recording the Borrower’s activity on such Remote Channels and the use of such collected data at the discretion of the Lender.

PRIVACY CLAUSE. The parties hereto acknowledge that federal and/or provincial legislation that addresses the protection of individuals’ personal information (collectively, “Privacy Laws”) applies to obligations and activities under this Indenture. Despite any other provision of this Indenture, neither party shall take or direct any action that would contravene, or cause the other to contravene, applicable Privacy Laws. The REIT, prior to transferring or causing to be transferred personal information to the Trustee, shall obtain and retain required consents of the relevant individuals to the collection, use and disclosure of their personal information, or shall have determined that such consents either have previously been given upon which the parties can rely or are not required under the Privacy Laws. The Trustee shall use commercially reasonable efforts ensure that its services hereunder comply with Privacy Laws. Specifically, the Trustee agrees: (a) to have a designated chief privacy officer; (b) to maintain policies and procedures to protect personal information and to receive and respond to any privacy complaint or inquiry; (c) to use personal information solely for the purposes of providing its services under or ancillary to this Indenture and not to use it for any other purpose except with the consent of or direction from the REIT or the individual involved; (d) not to sell or otherwise improperly disclose personal information to any third party; and (e) to employee administrative, physical and technological safeguards to reasonably secure and protect personal information against loss, theft, or unauthorized access, use or modification.
PRIVACY CLAUSE. Exhibitors shall maintain the confidentiality of any information on prospective clients included in any database distributed by the City (for each such prospect, a “Lead”), and shall not share Leads with third parties. Exhibitors may market their services to Leads; provided that Exhibitor complies with privacy laws, does not contact any Leads that have directly or indirectly advised Exhibitors that they do not wish to be solicited, and “blind carbon copies” the City on all electronic communication with Leads.
