Pro Rata Cash Payment. After distributing funds for the claim’s payments set forth above to claimants, as well as attorneys’ fees, Class Counsel’s litigation expenses, and Administrative Fees, if there is any money left over, the Settlement Administrator will make a pro rata settlement payment of the remaining Settlement Fund to each Settlement Class Member who submits a valid claim for a cash payment using this Claim Form.
Pro Rata Cash Payment. After the distribution of Administrative Fees, Service Awards, Out-of-Pocket Expense Claims (each of which is defined below in this Section), attorneys’ fees, and Class Counsel’s litigation expenses, the Settlement Administrator will make a pro rata cash payment of $70 of the remaining Settlement Fund to each Class Member who submits a Valid Claim. A Class Member is not required to provide any documentation or attestation to claim the cash payment.
Pro Rata Cash Payment. If the Settlement Fund is insufficient to cover all Out-of-Pocket Losses, such claims shall be reduced pro rata to account for the amount of remaining funds, and no money shall be paid to any claimants for CCPA Payments or Pro Rata Cash Payments. If there are sufficient funds to pay for all claimed Out-of- Pocket Losses, but insufficient funds to pay for all claimed CCPA payments, then claimants shall receive full value for their Out-of-Pocket Losses, but CCPA payments shall be reduced pro rata to account for the amount of remaining funds. Any remaining money in the Settlement Fund (to the extent any exists) after the payment of Out-of-Pocket Losses and CCPA Payments shall be disbursed in a pro rata amount to all valid claimants.
Pro Rata Cash Payment. All Settlement Class Members may submit a claim for a Pro Rata Cash Payment up to a maximum of Seventy Dollars and Zero Cents ($70.00) by submitting a Claim Form to the Settlement Administrator no later than the Claims Deadline. The Pro Rata Cash Payment will be calculated in accordance with Paragraph 60 below and may be decreased based on the number of valid claims submitted for this settlement benefit, but under no circumstances will exceed Seventy Dollars and Zero Cents ($70.00).
Pro Rata Cash Payment. After the calculation of attorneys’ fees, litigation expenses, Administrative Fees and Service Awards, the Settlement Administrator will calculate the amount of the Valid Claims and will make pro rata payments on the Cash Payments to each Class Member who submits a claim. This pro rata calculation may increase or decrease the amount of the Cash Payment.
Pro Rata Cash Payment. After the distribution of Attorneys’ Fees, Expenses, Administration and Notice Costs, Service Awards, Documented Ordinary Expense Reimbursement, Documented Extraordinary Expense Reimbursement, Lost-Time Reimbursement, and Credit Monitoring, the Settlement Administrator will make pro rata settlement payments of the remaining Settlement Fund to each Settlement Class Member who submits a valid claim for a Pro-Rata Cash Payment. The payment amount is estimated to be $50 and may increase or decrease pro rata based on the amount remaining in the Settlement Fund after the above distributions have been made. No documentation or attestation is required. Settlement Class Members cannot submit a Pro- Rata Cash Payment claim in conjunction with any other claim. The Pro-Rata Cash Payment claim may only be submitted in the alternative to all other claims.
Pro Rata Cash Payment. All Settlement Class Members who submit a valid claim using the Claim Form to this Settlement Agreement, may request a pro rata cash payment (either GIPA or Pro Rata Cash) (the “Cash Payment”). The Class Member may only choose one form of Cash Payment relied by submitting a Claim Form to the Settlement Administrator no later than 90 days after the Notice Date, or other deadline approved by the Court (the “Claims Deadline”). The Cash Payment will be calculated in accordance with ¶ 3.3 below. The Cash Payment amount per valid claim will be determined by the amount remaining in the Qualified Settlement Fund after deductions for Costs of Settlement Administration, and Fee Award and Costs.
(a) GIPA Cash Compensation (GIPA Cash Payment): After the distribution of attorneys’ fees, Class Counsel’s Litigation Expenses, Administrative Fees, Compensation for Out-of-Pocket Expenses, the Settlement Administrator will make pro rata settlement payments of 50% of any remaining settlement funds to each Illinois GIPA Subclass Member who submits a valid claim for GIPA cash compensation. This may result in a pro rata distribution of the GIPA Cash Payment amount and will be capped at $1,000. It is expected that the GIPA Cash Payment amount for each valid claim will exceed the amount of the Pro Rata Cash Payment.
i. Qualification for a GIPA claim will require attestation by Class Members stating generally that they are currently or formerly an Illinois resident and that they personally shared and provided their Genetic Information with NMH or any Elekta Customer located in Illinois at any time before the Data Security Incident.
ii. Any funds that remain after paying all claims up to the $1,000 cap, will be allocated to the Pro Rata Cash Payment in section 3.1(b).
Pro Rata Cash Payment. Participating Settlement Class Members can elect to make a claim for a pro rata share of the Net Settlement Fund, less all valid claims for Unreimbursed Losses. To receive this benefit, Participating Settlement Class Members must submit a valid claim form, but no documentation is required to make a claim. The amount of the Cash Payments will be increased or decreased on a pro rata basis, depending upon the number of valid claims filed and the amount of funds available for these payments. Class Counsel predicts the value of pro rata payments will exceed $50 per valid claimant.

The amount of this benefit shall be increased or decreased based on the funds remaining in the Settlement Fund following the payment of Attorneys’ Fees and Expenses Award, any Service Awards, the Costs of Claims Administration, claims for Out-of-Pocket Losses, and the CCPA Payments. Any increase will be done pro rata based on the amount of the claims. Any decrease will be done pursuant to Paragraph 2.3 above.
