Product Warranty Exclusions. The Limited Warranty does not apply to Product damage or defects which ZEISS determines, upon inspection, are caused due to: (i) unauthorized use with another product; (ii) accident, abuse, misuse, improper maintenance, liquid contact, fire, electrical failure, earthquake or other external cause beyond ZEISS’ reasonable control; (iii) damage caused by using the Product(s) outside ZEISS’ (IFU or DFU) published guidelines; (iv) use by un-trained or improperly trained or un-qualified personnel; (v) damage caused by service (repairs, alterations, or otherwise) performed by anyone who is not a representative of ZEISS or a ZEISS-authorized service provider; (vi) modifications made without the written permission of ZEISS; (vii) defects caused by normal wear and tear or otherwise due to the normal aging of the Product(s), (viii) unauthorized transportation from the initial delivery location or environmental conditions outside of those prescribed in the Product specifications, (ix) negligence, (x) improper packaging or shipment, storage, or (xi) re-use of the Product . Parts and accessories for Products, including but not limited to, cartridges, bulbs, flashtubes, lamps, filters, paper, printer ribbons, floppy disks, back-up media, user manuals, test xxxxxxxx, test eyes and test fixtures (collectively, “Excluded Consumables”) and items with a limited expected useful life are not subject to this limited warranty. On-site planned or preventive maintenance activities are not included as a part of this limited warranty.

In addition, unless approved in writing by QUALCOMM the warranty does not extend to any Product which is attached to or used with accessories, batteries, connectors, cabling or other items not provided or approved by QUALCOMM. Product is not specifically warranted to be appropriate for incorporation and use in any other product or for any use prohibited in the applicable Documentation. Customer hereby acknowledges and agrees that it has not relied on any representations or warranties other than those expressly set forth herein.

QUALCOMM hereby acknowledges that the Products will be incorporated into Customer’s products. QUALCOMM further acknowledges that Customer’s products are attached to or used with accessories, batteries, connectors, cabling or other items. QUALCOMM extends the warranty in Section 12.3 of the Agreement to such Products, so long as the Customer products, accessories, batteries, connectors, cabling or other items that such Products are attached to, used with or incorporated into properly protects such Products from operating conditions that fall outside those specified in QUALCOMM product specification PDD: 80-H3633-1. Rev. C or QUALCOMM’s product specification for the New Aircard, as applicable.”

Product Warranty Exclusions. Seller’s product warranties will not apply if Seller can prove that Defective Products have been: (a) subject to abuse, misuse, neglect, accident or improper installation by Buyer, its agents or customers, or (b) altered or repaired by a third party other than one authorized by Seller in writing.
