PROJECT ASSURANCES. Nothing in this Loan Agreement prohibits the Borrower from requiring more assurances, guarantees, indemnity or other contractual requirements from any party performing Project work.

PROJECT ASSURANCES. The Borrower hereby assures and certifies that it will comply with all regulations, policies, guidelines and requirements as they relate to the Revolving Loan Fund (RLF). The Borrower assures and certifies that: a. It will comply with Title VI of the Civil Rights Act of 1964 (P.L. 88-352) and in accordance with Title VI of the Act, no person in the United States shall, on the ground of race, color or national origin, be excluded from participation in, be denied the benefits of or be otherwise subjected to discrimination under any program or activity for which the applicant receives Federal financial assistance and will immediately take any measures to effectuate this agreement. If any real property or structure thereon is provided or improved with the aid of Federal financial assistance extended to the applicant, this assurance shall obligate the applicant, or in the case of any transfer of such property, any transferee, for the period during which the real property or structure is used for a purpose for which the Federal financial assistance is extended or for another purpose involving the provision of similar services or benefits. b. It will comply with the Civil Rights laws listed below, and with any subsequent modifications of those regulations. The application of these laws is described and explained in EDA's Civil Rights Guidelines. 1. Section 112 of Public Law 92-65 (42 U.S.C. 3123). Prohibits sex discrimination in assistance provided under the Public Works and Economic Development Act of 1965, as amended. 2. Section 504 of the Rehabilitation Act of 1973 (26 U.S.C. 794 AND 15 CFR Part 8b, subsections a, b, c and e (Regulations of the Department of Commerce implementing Section 504 of the Rehabilitation Act). Prohibits discrimination against the handicapped in any program or activity receiving Federal financial assistance. 3. Section 303 of the Age Discrimination Act of 1975 (42 U.S.C. 6102). Prohibits discrimination on the basis of age in any program or activity receiving Federal financial assistance. 4. Executive Order 11246. Provides that Federal contractors or Federally assisted contractors shall not discriminate on the basis of race, color, religion, sex or national origin. 5. Title 13 CRF Part 31 1. (Civil Rights regulations of the Economic Development Administration). 6. PROJECT ASSURANCES. A. The MLBO shall be responsible for water sampling according to MNPCA protocol and procedures at one site located at Lake Shakopee, Lake ID# 48-0012-00-101, Lat 46.10776 Long -93.71975, documentation of which is to be sent to MLSWCD so that they may use the information for reporting purposes. B. The MLBO is responsible to follow MNPCA project operations and procedures as described in the Attachment A Workplan.
