Proof of service. In proving service of the communication, it shall be sufficient to show that delivery by hand was made or that the envelope containing the communication was properly addressed and posted as a first class pre-paid letter or that the facsimile was despatched and a confirmatory transmission report received.
Proof of service. In proving service of a notice or other communication, it is sufficient to prove that delivery was made or that the e-mail was properly addressed and transmitted by the sender’s server into the network and there was no apparent error in the operation of the sender’s e-mail system, as the case may be.
Proof of service. A certificate of any officer of the Corporation in office at the time of the making of the certificate or of a transfer officer of any transfer agent or branch transfer agent of shares of any class of the Corporation as to facts in relation to the mailing or delivery or service of any notice or other documents to any shareholder, director, officer or auditor or publication of any notice or other document, shall be conclusive evidence thereof and shall be binding on every shareholder, director, officer or auditor of the Corporation, as the case may be.
Proof of service. In proving service of a demand, notice, communication or other document served:
(a) by post, it shall be sufficient to prove that such demand, notice, communication or other document was correctly addressed, full postage paid and posted; and
(b) by fax, it shall be sufficient to prove that the fax was followed by such machine record as indicates that the entire fax was sent to the relevant number.
Proof of service. In proving service, it shall be sufficient to prove that: the envelope containing the notice or other communication was addressed to the address of the relevant Party as set out in Clause 16.1(a) (Method of Service) (or as otherwise notified by that Party pursuant to Clause 16.5 (Change of Address)) and delivered either to that address or custody of the courier or international courier firm; or the notice or other communication was transmitted in full by facsimile to the facsimile number of the relevant Party set out in Clause 16.1(a) (Method of Service) (or as otherwise notified by that Party pursuant to Clause 16.5 (Change of Address)) (as evidenced by a confirmatory transmission report); or that the e-mail was correctly addressed and that no delivery failure was reported to or by the sender's e-mail server.
Proof of service. In proving service of any notice it will be sufficient to prove, in the case of a letter, that such letter was properly stamped or franked first class, addressed and placed in the post or, in the case of personal delivery, when left at the correct address and, in the case of a facsimile transmission, that such facsimile was duly transmitted to the facsimile number of the addressee referred to in Clause 9.1 above.
Proof of service is a document that states the facts in regards to service. It also contains the diligence which is supporting facts of the service.
D. Service Packet: One service package consists of the following documents: Summons Complaint, Income and Expense Declaration, health Insurance Information Form, Answer to Governmental Complaint and Child Support Handbook, and other documents as required by the Court.
Proof of service. Wherever Proof of Service is required in this Agreement, it shall be accomplished through the following vehicles only:
1. When delivery is by U.S. Mail, the person mailing shall complete and sign the prescribed and appropriate Proof of Service form which shall indicate that they have personally deposited with or presented to the U.S. Postal Service the document(s) being mailed;
2. When delivery is through personal presentation of a document(s), Proof of Service is accomplished and recorded by:
a. the person presenting the document(s) completing and signing the prescribed and appropriate Proof of Service form which shall indicate they have delivered the document(s) by hand and to whom the document(s) were delivered; or
b. the person delivering the document(s) and the person accepting delivery of the document(s) shall mutually acknowledge the delivery/receipt by signing and dating the document(s) and a copy of the document(s) and each of them retaining one of the signed and dated document(s); or
3. Email to XxxxxxXXxxxxxxxx@xxxx.xxx.
a. Email submissions must include PDFs of all documents, information and signatures necessary to be in compliance with the Grievance Procedure provisions of this Agreement.
b. The ‘date of filing’ for emailed Appeals to Step 3 shall be the date received on the University server, provided that the appeal is received during business hours. If a Step 3 appeal is received outside of normal business hours, the first following business day will be deemed the filing date of the Appeal to Step 3.
c. The University shall acknowledge the Union’s Appeal to Step 3 through a computer-generated, automatic email response.
Proof of service. In proving the giving of a notice or any other document under or in respect of this Agreement it shall be sufficient to show:-
15.4.1 in the case of registered post, express or air mail or other fast postal service, that the notice or other document was duly addressed and posted; or
15.4.2 in the case of facsimile transmission or other instantaneous electronic media, that the notice or other document was duly transmitted from the despatching terminal as evidenced by a transmission report generated by the despatching terminal.
Proof of service. In proving the giving of a notice or other communication, it shall be sufficient to prove that delivery was made or in the case of email that the sender has a confirmation that the email was delivered, as the case may be.
