PURPOSE OF GRIEVANCE. This Article provides for an orderly and sole procedure for the processing of Individual, Board and Association grievances pertaining only to the interpretation or application of express provisions of this Agreement. The grievance process shall not apply, and the Board’s decision shall be final and binding, as to the following matters: (1) any matter for which a specific method of review is prescribed by law; (2) any rule or regulation by the State Department of Education; (3) any by-law of the School Board pertaining to its internal organization; (4) any matter which according to law is either beyond the scope of Board authority or limited to unilateral action by the Board alone; (5) a complaint by an employee which arises by reason of his or her not being re-employed; (6) a complaint by an employee occasioned by appointment to, lack of appointment to, retention or lack of retention in any position for which “tenure” is not possible or not required.
PURPOSE OF GRIEVANCE. The purpose of the grievance procedure shall be to provide a method for complaints to be voiced in an orderly manner such that the proper authority can resolve such matters fairly and in a timely manner.
PURPOSE OF GRIEVANCE. The purpose of this grievance procedure is to secure, at the lowest possible level, equitable solutions to problems which may occur concerning interpretation, application, or meaning of the terms and conditions of employment of the District. An underlying principle of the grievance procedure is to ensure fair and equitable treatment to the District’s employees while also maintaining District standards. The acceptance of this procedure does not in any way diminish the legal responsibility for the Board to set education policies for the District. Definition of Grievance. A grievance is a claim by an employee or group of employees that there has been a violation, misinterpretation or misapplication of any terms and condition of employment set forth in this Negotiated Agreement.
