Reduction of Work Year. For 2017-2018 and 2018-2019 the work year for unit members will be temporarily reduced as follows: A. AASD Unit Members Excluding School Police Effective July 1, 2017: 1. Traditional Work-Year Calendars i. 10-Month (217-day) calendars shall be reduced by eleven (11) furlough days, consisting of six (6) days during Winter Break and five (5) days during Spring Break. The work year shall be 206 days. Unless the parties agree to extend the furlough, effective July 1, 2019 employee’s pay will no longer be reduced by eleven (11) furlough days.
Reduction of Work Year. A. For the 2010-2011 and 2011-2012 fiscal year, the parties agree to five (5) work year reduction days for each of those fiscal years. These days are in addition to the ten (10) or six (6) work year reduction days given in 2004 by certificated unit members. Dates of these five (5) additional work year reduction days shall be arranged and agreed to individually between the bargaining unit members and their supervisor, prior to the end of the 2010-2011 and 2011-2012 fiscal years, respectively. B. For the purpose of retirement calculations, PERS and STRS determine how many days constitute full credit for one work year. It is not the intent of either party to reduce the work year of a bargaining unit member, or a class of members, below the number of workdays required by STRS or PERS. 1. During the 2009 bargaining the parties discovered that the five (5) furlough days in Section 2. A would adversely affect a full year’s STRS service credit for Vice Principals. For that reason, vice principal furlough days for 2010-2011 and 2011-2012 will be modified as follows: a. Every vice principal shall work an additional two days for the duration of the July 1, 2010 through June 30, 2013 contract unless there is a bargained modification to this specific Section. b. The additional two (2) days shall be identified and/or designated and/or approved by the appropriate district representatives. c. The additional two (2) days of work shall not be voluntary. d. Every vice principal shall add two (2) days to the appropriate work years (2010- 2011 and 2011-2012). This modification is being made for the sole intent of keeping the vice principals work calendar within the statutory requirements for a full work year. If the STRS regulations are modified during the term of this agreement to reduce the number or required days, this Section shall be modified to parallel the change in requirement. C. To implement Section 0.X, XXXX unit member work years will be reduced accordingly; if work year reduction days are in effect, the District will ensure that unit members received a complete year of service credit for the 2010-2011 and 2011-2012 fiscal years. D.   • Location of Work The Executive shall be based in the United States in West Orange, New Jersey. However, the Executive agrees to undertake whatever domestic and worldwide travel is required by the Company. The Executive shall not be required or permitted to relocate without the mutual, written consent of the Executive and the Company.

  • CORRECTION OF WORK 13.2.1 The Contractor shall be responsible for correcting all Work which the Architect has found to be defective or which fails to conform to the Contract Documents whether observed be- fore or after Substantial Completion and whether or not fabricated, installed or completed. The Contractor shall bear all costs of correcting such rejected Work, including compensation for the Architect's and the State’s additional services made necessary thereby. 13.2.2 If, within one year after the Date of Substantial Completion of the Work or designated portion thereof or within one year after acceptance by the State of designated equipment or within such longer period of time as may be prescribed by law or by the terms of any applicable special warranty required by the Contract Documents, any of the Work is found to be defective or not in accordance with the Contract Documents, the Contractor shall correct it promptly after receipt of a written notice from the State to do so unless the State has previously given the Contractor a written acceptance of such condition. This obligation shall survive termination of the Contract. The State shall give such notice promptly after discovery of the condition. 13.2.3 The Contractor shall remove from the site all portions of the Work which are defective or non-conforming and which have not been corrected under Subparagraphs 4.5.1, 13.2.1 and 13.2.4 If the Contractor fails to correct defective or nonconforming Work as provided in Subparagraphs 4.5.1, 13.2.1 and 13.2.2, the State may correct it in accordance with Paragraph 13.2.5 If the Contractor does not proceed with the correction of such defective or non- conforming Work within a reasonable time fixed by written notice from the Architect, the State may remove it and may store the materials or equipment at the expense of the Contractor. If the Contractor does not pay the cost of such removal and storage within ten days thereafter, the State may upon ten additional days written notice sell such Work at auction or at private sale and shall account for the net proceeds thereof, after deducting all the costs that should have been borne by the Contractor, including compensation for the Architect's and the State’s additional services and expenses made necessary thereby. If such proceeds of sale do not cover all costs which the Contractor should have borne, the difference shall be charged to the Contractor and an appropriate Change Order shall be issued. If the payments then or thereafter due the Contractor are not sufficient to cover such amount, the Contractor shall pay the difference to the State. 13.2.6 The Contractor shall bear the cost of making good all work of the State or separate contractors destroyed or damaged by such correction or removal. 13.2.7 Nothing contained in this Paragraph 13.2 shall be construed to establish a period of limitation with respect to any other obligation which the Contractor might have under the

  • Rejection of Work Using the Notice of Non-Conforming Work procedures outlined in the General Conditions, the Design Professional shall reject work that does not comply with the requirements of the Contract Documents or that does not comply with the applicable laws and codes. The Design Professional shall have authority to order testing of the Work, as is provided in the Contract Documents or as otherwise required in its judgment, whether such work is fabricated, installed, or completed.

  • Commencement of Work Engineer shall not commence any field work under this Contract until he/she/it has obtained all required insurance and such insurance has been approved by County. As further set out below, Engineer shall not allow any subcontractor/subconsultant(s) to commence work to be performed in connection with this Contract until all required insurance has been obtained and approved and such approval shall not be unreasonably withheld. Approval of the insurance by County shall not relieve or decrease the liability of Engineer hereunder.

  • UNCOVERING OF WORK 13.1.1 If any portion of the Work should be covered contrary to the request of the Architect or to requirements specifically expressed in the Contract Documents, it must, if required in writing by the Architect, be uncovered for his or her observation and shall be replaced at the Contractor's expense. 13.1.2 If any other portion of the Work has been covered which the Architect has not specifically requested to observe prior to being covered, the Architect may request to see such Work and it shall be uncovered by the Contractor. If such Work is found in accordance with the Contract Documents, the cost of uncovering and replacement shall, by appropriate Change Order, be charged to the State. If such Work is found not to be in accordance with the Contract Documents, the Contractor shall pay such costs unless it is found that this condition was caused by the State or a separate contractor as provided in Article 6 of these General Conditions, in which event the State shall be responsible for the payment of such costs.

  • Completion of Work The Contractor agrees to complete the work on, or before October 29, 2021.

  • REDUCTION IN WORK FORCE (1) In the event of a reduction in the work force, regular full-time and regular part-time employees shall be laid off in reverse order of seniority, provided that there are available employees with greater seniority who are qualified and have the ability to do the work of the employees laid off. The Employer shall give regular employees written notice of layoff or normal pay for that period in lieu of notice as follows: i) One (1) weeks’ notice after three (3) consecutive months of employment, ii) Two (2) weeks’ notice after twelve (12) consecutive months of employment, iii) Three (3) weeks’ notice after three (3) consecutive years, plus one additional week for each additional year of employment to a maximum of eight (8) weeks. iv) Employees shall be entitled to Group Termination notice/pay pursuant to Section 64 of the Employment Standards Act. (2) Laid-off regular employees shall retain their seniority and perquisites accumulated up to the time of layoff, for a period of one (1) year and shall be rehired, if the employee possesses the capability of performing the duties of the vacant job on the basis of the posting procedure. If a laid-off employee is not recalled to work within twelve (12) calendar months of layoff, such employee may be terminated by written notification at the expiration of the twelve (12) calendar month period. Laid-off employees failing to report for work of an ongoing nature within seven (7) days of the date of receipt of notification by registered mail shall be considered to have abandoned their right to employment. Employees required to give two (2) weeks' notice to another Employer shall be deemed to be in compliance with the seven (7) day provision. (3) Where a notice of displacement or layoff actually results in a layoff and prior to the layoff becoming effective, two (2) copies of such notice shall be sent to the Secretary-Treasurer of the Local.

  • Length of Work Year 1. The length of the work year for custodians, accountants, (excluding school lunch accountant), personnel specialist, maintenance, maintenance helpers, mechanics, purchasing coordinator, county receptionist, warehouse and property records coordinator shall be twelve months. 2. The length of the work year for attendance assistant and bus drivers shall be 188 days. 3. The length of the work year for school food service shall be 194 days.

  • Period of Work Work under this Agreement shall begin no sooner than the date on which this Agreement has been fully executed by the parties and approved by the Controller and the State Purchases Review Committee. Unless terminated earlier, this Agreement shall expire on the date set out on the first page of this Agreement, or at the completion and acceptance of all specified tasks, and delivery of all contracted products and services as defined in this Agreement, including performance of any warranty and/or maintenance agreements, whichever is the later date.
