Road Maintenance Funding. Until 0000, x xxxx fund existed, financed from the proceeds of the fuel tax, the international transit tax and a road usage tax levied on individuals and enterprises. In 2004, the Government abolished special funds, including the road fund, and since then the sector has been funded directly from the state budget, including through donor funds. The proceeds of the transport related taxes and fees are nowadays part of the general revenue and are not earmarked specifically for road maintenance. Under the proposed RD maintenance program for 2009-2013, an increase in annual funding from $110 million to $137 million is planned, with most of the increase earmarked for the periodic maintenance program. In 2007, the responsibility for local roads was transferred from RD to 69 local authorities, as part of broader public sector reform aimed at decentralizing government functions. An estimated GEL1,450 million is needed to rehabilitate the local road system (90% in poor condition) and bring it up to a maintainable condition. Despite the growing need for road maintenance, how to fund it remains a challenge. Donors closely coordinate to assist RD in effectively coping with the challenge. For example, the World Bank is supporting RD in improving the efficiency of its road maintenance activities by shifting from contracted-out maintenance to performance-based maintenance contracts. The Program will also support introduction of the performance-based maintenance contract and assist RD in carrying out this task.

Separate to the arrangements in clauses 30 to 33, the Parties agree that Commonwealth annual road maintenance funding will be determined each year by application of a formula based on lane length, total traffic volumes and heavy vehicle traffic volumes for non-tolled roads on the National Land Transport Network. Commonwealth road maintenance funding will be provided to the State on condition that the State: maintains National Land Transport Network roads within that State to an agreed level of service, which is equal or superior to the current level of service; and supplies agreed data on the condition and usage of, and maintenance expenditure on, the Network to enable the Commonwealth to meet its accountability and reporting requirements. The States agree that annual road maintenance funding is only to be spent on non-tolled roads on the National Land Transport Network. The Commonwealth will advise the States of the total Commonwealth funding to be provided for road maintenance each year as set out in the Schedule, and will seek the States’ written agreement to any additional conditions that apply.   • Road Maintenance Purchaser shall maintain roads, commensurate with Purchaser’s use, in accor- dance with Road Maintenance Requirements in C5.31 and the Road Maintenance Specifications. Performance of road maintenance work by Purchaser may be required prior to, during, or after each period of use. The timing of work accomplishment shall be based on Purchaser’s Op- erating Schedule under B6.31. When two or more commercial users are simultane- ously using the same road where Forest Service is not requiring maintenance deposits, the commercial users will develop maintenance responsibilities and arrangements for accomplishing the work. Forest Service must agree to this plan. If the commercial users cannot agree on main- tenance responsibilities, Forest Service shall resolve the differences. If Purchaser elects to use different roads than those listed in C5.31, Forest Service shall determine Pur- chaser’s commensurate share of road maintenance and revise road maintenance deposits in C5.32. If Forest Service cannot perform its full commensu- rate share of road maintenance, Forest Service shall make a cash payment to Purchaser for performance of such work. Unless agreed in writing, prehaul maintenance shall be completed on any portion of road prior to hauling on that portion. Maintenance, as used in this contract, does not include road reconstruction or repairs of an extraordi- nary nature.
