Safety and Environmental Protection. 8.1 Delivered goods and rendered services must comply with the statutory provisions, in particular safety and environmental protection provisions. 8.2 In the case of deliveries and the rendering of services, the Supplier shall have sole responsibility for adhering to the accident-prevention regulations. Protective equipment as well as any possible instructions of the manufacturer which are required under such regulations must be included with the delivery free of charge.

The Parties shall adopt, where appropriate, common safety and environmental standards and requirements applicable to activity contemplated under this Agreement. In any event, the Parties shall strive to ensure that their respective standards and requirements are compatible where necessary for the safe, effective, and environmentally responsible Implementation of thisAgreement. 2. Safety and Environmental Protection a) If, at any time prior to or during delivery, Seller reasonably determines that the circumstances for delivery are unsafe or have the potential for a spill (as defined in Section 9 (c) below) occurring due to conditions such as, but not limited to, unsafe or inadequate working environment, practices or procedures, facilities, tools or equipment, incompatible configurations or bad weather, Seller reserves the right not to commence delivery or to terminate the supply immediately without any prior notice to Buyer and without liability. Buyer shall be solely responsible for any loss or damage occurring on board or to the Vessel resulting from any incident arising out of or in connection with any such conditions. b) By purchasing Marine Fuels from Seller, Buyer warrants that it is familiar with the health effects related to Marine Fuels supplied hereunder and with relevant protective safety and health procedures for the handling and use of such Marine Fuels. Buyer shall adhere to such safety and health procedures while using or handling Marine Fuels. Buyer shall also facilitate the dissemination of health and safety information to all employees, users, and others potentially exposed to Marine Fuels sold hereunder. Buyer shall be responsible for compliance by its employees, agents or contractors, and other users with all health and safety requirements or recommendations related to Marine Fuels supplied hereunder and shall exert its best efforts to assure that any of its employees or agents, users, and others avoid frequent or prolonged contact with or exposure to Marine Fuels both during and subsequent to delivery. Seller or Seller’s supplier accepts no responsibility for any consequence arising from failure by Buyer, its employees, agents, contractors, any users, or any other party to comply with relevant health and safety requirements or recommendations relating to such contact or exposure. c) If a spill occurs while Marine Fuels are being delivered, Buyer and Seller shall promptly take such action as is reasonably necessary to contain and remove the spilled Marine Fuels and mitigate the effects of such spills. Seller is hereby authorized, at its option and at the expense of Buyer, to take such measures and incur such expenses (whether by employing its own resources or contracting with others) as are reasonably necessary in the judgment of Seller to remove the spilled Marine Fuels and mitigate the effects of such spills. Safety and Environmental Protection. (A) YMCA shall operate and maintain the Licensed Area so as to avoid injury or damage to any person or property. In carrying out its work, YMCA shall at all times, exercise all necessary precautions for the safety and environmental protection of the Licensed Area and Property, and be in compliance with all federal, state and local statutory and regulatory requirements including State of California, Division of Industrial Relations (Cal/OSHA) regulations, Cal/EPA, and US/EPA (as applicable). (B) YMCA shall defend, indemnify and hold harmless the City and its partners, affiliates, agents and employees against any and all losses, liabilities, claims and/or costs (including reasonable attorneysfees and costs) arising from any breach of any representation, warranty or agreement contained in this section. This section shall survive the termination of this Agreement.

Safety and Environmental Protection. (a) It shall be the sole responsibility of the Buyer to ensure that the Vessel, its crew and those responsible for its operation and management, observe and comply with all health, safety and environmental laws and regulations with regard to the receipt, handling and use of the Marine Fuel. The Customer warrants that the Vessel is in com- pliance with all national and international trading and pollution regulations and free of all conditions, deficiencies or defects. The Seller and/or its supplier reserve the right not to commence delivery or to terminate delivery without recourse to the Customer in the event that they deem the environment for delivery of the Marine Fuel to be unsafe. (b) In the event of any escape, spill or discharge occurring before, during or after the delivery of the Products, the Customer shall, in addition to any other obligations imposed by law, immediately notify the appropriate gov- ernmental authorities and take or arrange whatever action is necessary to respond and clean up such spill or discharge, and pay all costs and expenses in connection therewith. If the Customer fails to take such prompt action, the Seller or its representatives shall be authorised to take such action on behalf of the Customer at the Customer’s risk and expense. The Customer shall indemnify and hold the Seller and its representatives harmless against any damages, expenses, claims or liabilities of whatever nature, unless such escape, spill or discharge is proven to be caused solely by the Seller’s negligence.
Safety and Environmental Protection. 26.1 In carrying out its work, Tenant shall at all times, exercise all necessary precautions for the safety and environmental protection of the Coffee/Juice Bar, and be in compliance with all federal, state and local statutory and regulatory requirements including State of California, Division of Industrial Relations (Cal/OSHA) regulations, Cal/EPA, US/EPA and the U.S. Department of Transportation including the Omnibus Transportation Employee Testing Act (as applicable). 26.2 Tenant shall not use or allow anyone else to use the Coffee/Juice Bar to generate, manufacture, refine, transport, treat, store, handle, recycle, release or dispose of any hazardous material, other than as reasonably necessary for the operation of the Tenant’s activities as contemplated under this Agreement. The term "hazardous material" means any hazardous substance, material or waste, including but not limited to those listed in 49 CFR 172.101 (U.S. Department of Transportation), the Cal/EPA Chemical Lists of lists or petroleum products and their derivatives. However, this shall not apply to the use of petroleum products and related substances incidental to operation of motorized equipment and vehicles whose operation in the Coffee/Juice Bar is contemplated by this Agreement. 26.3 Tenant shall immediately notify the Landlord in writing upon becoming aware of any release of hazardous material, violation of any environmental law or actions brought by third parties against the Tenant alleging environmental damage. 26.4 Landlord represents, warrants and agrees (1) that neither Landlord nor, to Landlord’s actual knowledge (without Landlord having researched the matter), any third party has used, generated, stored or disposed of, or permitted the use, generation, storage or disposal of, any hazardous material on, under, about or within the Coffee/Juice Bar in violation of any law or regulation, and (2) that Landlord has not, and will not permit any third party to use, generate, store or dispose of any hazardous material on, under, about or within the Fontana Community Senior Center in violation of any law or regulation. 26.5 Landlord and Tenant each agree to defend, indemnify and hold harmless the other and the other's partners, affiliates, agents and employees against any and all losses, liabilities, claims and/or costs (including reasonable attorneysfees and costs) arising from any breach of any representation, warranty or Agreement contained in this section.
