Safety Markings. All Collection equipment used by Contractor must have appropriate safety markings including, but not limited to, highway lighting, flashing and warning lights, clearance lights, and warning flags. All such safety markings must be in accordance with the requirements of the California Vehicle Code, as may be amended from time to time.

Safety Markings. All Collection equipment used by FRANCHISEE shall 624 have appropriate safety markings including, but not limited to, highway lighting, flashing and 625 warning lights, clearance lights, and warning flags. All such safety markings shall be subject to 626 the approval of the CITY and shall be in accordance with the requirements of the California 627 Vehicle Code, as may be amended from time to time.

No advertising is permitted other than the 1475 name of Contractor, its logo and registered service marks, except promotional advertisement of the Organic 1476 Waste programs, which is encouraged. City to approve any promotional material of the Organic Waste 1477 Programs affixed to or painted on Contractor’s Collection Vehicles and may require such promotion to be 1478 utilized from time to time in order to encourage correct Recycling, reduce Contamination, and provide 1479 relevant education. Contractor must repaint all Collection Vehicles during the term of this Agreement on a 1480 frequency as necessary to maintain a positive public image as reasonably determined by the Agreement 1481 Administrator, but not less often than once every five years beginning January 1, 2023.

All such safety markings shall be subject to the approval of the 2050 CITY shall be in accordance with the requirements of the California Vehicle Code, as may be 2051 amended from time to time. 2052 15.05 Vehicle Signage and Painting. Collection vehicles shall be painted and 2053 numbered without repetition and shall have the CONTRACTOR'S name, CONTRACTOR’S 2054 customer service telephone number, and the number of the vehicle painted in letters of 2055 contrasting color, at least two and one-half (2 1/2) inches high, on the front and back of each 2056 vehicle. CONTRACTOR 2059 shall repaint all vehicles (including vehicles striping if appropriate) during the term of this 2060 Agreement on a frequency as necessary to maintain a positive public image as reasonably 2061 determined by the Contract Administrator. 2062 15.05.1 Bin, Compactor and Roll-Off Box Signage, Painting, and Cleaning. 2063 All metal Bins, Compactors or Roll-Off Boxes furnished by the CONTRACTOR shall be either 2064 painted or galvanized. All Bins, Compactors or Roll-Off Boxes shall display the 2065 CONTRACTOR’S name, CONTRACTOR’S toll free customer service telephone number, and 2066 shall be kept in a clean and sanitary condition. Each Bin, Compactor or Roll-Off Box shall 2067 include a description of the type of material to be placed in the Container and shall be painted 2068 in a color and manner, acceptable to CITY, which is unique to that type of material. Such 2069 Bins, Compactors or Roll-Off Boxes as are provided by CONTRACTOR shall be steam 2070 cleaned and repainted by CONTRACTOR as frequently as necessary, but no more often 2071 than one (1) time per quarter, so as to maintain them in a sanitary condition. However, no 2072 more often than one (1) time per quarter, upon receipt of notification by CONTRACTOR of 2073 graffiti on a Bin, Compactor or Roll-Off Box, CONTRACTOR shall clean or replace such Bin, 2074 Compactor or Roll-Off Box within seven (7) Work Days.   • CONTRACT WORK HOURS AND SAFETY STANDARDS As per the Contract Work Hours and Safety Standards Act (40 U.S.C. 3701-3708), where applicable, all Customer Purchase Orders in excess of ,000 that involve the employment of mechanics or laborers must include a provision for compliance with 40 U.S.C. 3702 and 3704, as supplemented by Department of Labor regulations (29 CFR Part 5). Under 40 U.S.C. 3702 of the Act, each contractor must be required to compute the wages of every mechanic and laborer on the basis of a standard work week of 40 hours. Work in excess of the standard work week is permissible provided that the worker is compensated at a rate of not less than one and a half times the basic rate of pay for all hours worked in excess of 40 hours in the work week. The requirements of 40 U.S.C. 3704 are applicable to construction work and provide that no laborer or mechanic must be required to work in surroundings or under working conditions which are unsanitary, hazardous or dangerous. These requirements do not apply to the purchases of supplies or materials or articles ordinarily available on the open market, or contracts for transportation or transmission of intelligence.
