Section 10.9. Layoff. 30 In the event of layoff, an employee may return to their previous job classification at the retained 31 seniority level in that classification. They may only bump an individual with less seniority in the 32 previous classification. Employees affected by a layoff shall be placed on an employment list 33 maintained by the District. Such employees will be recalled according to seniority rank, for openings 34 in the classification held immediately prior to layoff. Names shall remain on the layoff list for one (1) 35 year. Open positions will be posted for the consideration of current employees within the classification 36 before those openings are offered to employees on lay off. 37

Section 10.9. Layoff. 22 In the event of layoff, employees so affected are to be placed on a reemployment list maintained by the 23 District according to seniority within the classifications affected by such layoff. In the event that the 24 District re-establishes the layoff positions or makes additional classified positions available, such 25 employees who apply are to have priority over applicants from other classifications, substitute 26 employees, and applicants from outside the bargaining unit, by seniority if qualified, in filling any 27 opening within the classification(s) held prior to layoff. If performance or ability of an employee are a 28 concern, the requirement of Section 10.6.2. shall apply. Names shall remain on the reemployment list 29 for one (1) year.

Such employees are to have priority over junior employees 4 and outside candidates in filling an opening in the classification held immediately prior to layoff.
Section 10.9. Layoff. 29 In the event that a reduction in force causes an employee to lose more than one-half (½) hour of time, that 30 employee shall be entitled to bump a less senior employee within a general job classification in which the 31 employee has held status which is substantially equal or less than the current position. No employee may 32 bump into a higher paid position, to gain more time than they previously had, or to enter a position for 33 which they are not qualified. The District shall have the right to require the employee to bump the least 34 senior employee filling a position of appropriate hours which the senior employee is qualified by having 35 the skills and abilities to perform, provided that such decision does not adversely affect the bumping 36 employee financially. The Association shall be provided a contemporaneous copy of the reduction in 37 force notice and notice of re-employment. 38
