Employees on lay off shall be recalled in the inverse order of lay-off, provided no intervening factors have occurred which essentially change the ability of the employee to perform the offered employment.
Employees on lay off shall continue to accumulate seniority until the employee loses their seniority in accordance with Article 13.03(c).

a) Notwithstanding the other provisions of this Article, where an Employee is laid-off because of the return to work of an Employee who has been off work on Workers' Compensation or who has been off work on sick leave and has exhausted benefits under Article 28, any individual to be laid-off shall receive one (1) months’ notice, or as required by the Employment Standards Xxx 0000, whichever is the greater.
b) In the circumstances set out in 16.9 a), the Union shall receive equivalent notice.
c) In the circumstances set out in 16.9 a), the Employer shall notify the Employee and the Union promptly upon becoming aware of the impending return to work of an Employee.
Employees on lay off will be given the opportunity to fill temporary positions/vacancies of greater than ten (10) consecutive working days. Employees will not be obligated to accept these positions. Employees on lay- off who are filling temporary positions/vacancies will not forfeit their recall rights to permanent work.
Employees on lay off shall be recalled in the order of their seniority. Seniority may be by-passed for an employee where the employee does not have the required qualifications or ability to perform the available work. Seniority shall be a factor in employee requests for is defined as a permanent move one department to another within the bargaining unit resulting in no of classification or annual salary for the employee.

(a) Notwithstanding Article 13.09, an employee on lay-off or on recall to a temporary position will have their transfer requests under Article 13.09 suspended during the period of lay-off or temporary recall.
(b) Vacant positions will be posted in accordance with Article 13.01 and employees on lay-off may apply.
(c) The Employer has no responsibility for notifying employees on lay-off of vacancies and/or posted positions. The Board provides a posting hotline number and such number is available from the Employee Services Department.
Employees on lay off shall retain their seniority for purposes of recall
Employees on lay off status shall be recalled, in order of seniority, for any job vacancy for which they are qualified. Employees on lay-off status shall be informed of recall opportunities by contact from the Employer by either telephone and/or certified mail. The employee shall notify the Employer of their decision regarding the available position within three (3) days of notification. If the employee accepts the position, the employee shall report to work no later than fifieen (15) days afier accepting the position. An employee who fails to respond to a job offer or return to a position which the employee has accepted as specified above, shall forfeit further recall rights unless such failure to contact the Employer was due to good cause.
