Section 10.6.2. In the event of a layoff, the employee within the affected job classification, with the least seniority, 4 shall be the first employee to be laid off, provided the remaining employees are qualified to 5 perform the work. Job classifications are set forth in Article I, Section 1.4. The procedures for 6 layoff are set forth in Sections 10.9 through 10.12.
Section 10.6.2. 40 All vacancies within the bargaining unit shall be posted in the workplace for five (5) working 41 days prior to the closing of the acceptance of applications. Applications will be reviewed, and a 42 response given to the applicant within ten (10) working days.
Section 10.6.2. Employees who change job classifications within the bargaining unit as outlined in Section 1.4, 6 shall retain their seniority date in the previous classification for a period of one (1) year, this 7 seniority shall stop accruing on the last day in the previous classification. Notwithstanding that 8 they have acquired a new seniority date and a new classification.
Section 10.6.2. The employee with the earliest hire date shall have preferential rights regarding shift selection, 23 vacation periods, promotions and/or transfers to new or open positions, and layoffs, when 24 ability or performance are substantially equal with other candidates. If the District determines 25 that preferential requirements are not governed because another candidate possesses ability and 26 performance greater than a senior employee or employees, the employee not selected for 27 promotions or transfers may meet with the Chief Human Resource Officer to discuss the 28 reasons for the decision. Any grievance filed over this section, in a seniority bypass situation, 29 would begin at level three (3), and, if possible, the supervisor/manager in charge of the 30 selection decision would be present.
Section 10.6.2. 43 The employee with the earliest seniority date shall have preferential rights regarding 44 promotions, assignment to new or open jobs or positions, hours of work within positions 45 (employees who are currently working less than a forty (40) hour workweek would have 46 priority when assigning additional time. For transportation, reference Section 20), reduction in 47 hours, and layoffs when ability and performance are substantially equal with junior employees.
Section 10.6.2. 39 Employees selected for an additional part-time position in another general job classification 40 shall establish seniority and longevity as of the date on which the employee began continuous 41 daily employment in the additional part-time position. 42
Section 10.6.2. 43 Employees shall be allowed to move into positions held by the least senior employees within the 44 pay level. Employees who may be moved out of their pay level shall be allowed to move into 45 positions within "lower" pay levels based on 10.6.2.; provided, however, that no employee shall be 46 allowed to move into a higher pay level.
Section 10.6.2. The employee with the earliest hire date shall have preferential rights regarding 28 promotions, assignment to new or open jobs or positions, hours of work within positions (employees who 29 are currently working less than a forty (40) hour workweek would have priority when assigning additional 30 time. For transportation, reference sec 20), reduction in hours, and layoffs when ability and performance 31 are substantially equal with junior employees. If the District determines that seniority rights should not 32 govern because a junior employee possesses ability and performance substantially greater than a senior 33 employee or senior employees, in those qualifications enumerated in the applicable job descriptions, the 34 District shall set forth in writing to the employee or employees and the Association President its reasons 35 why the senior employee or employees have been bypassed. In the Food Service department, the 36 following will apply:
Section 10.6.2. 1. With the exception of the positions described in Sections 7.2.1 and 20.4, increases or 2 decreases in excess of two (2) hours or more to a job assignment during any school year shall be 3 considered new positions, and shall be posted in accordance with the terms of this Agreement.
