SECURITY AND UNAUTHORISED USE. 6.1 The Customer acknowledges that the PIN selected acts as an authorized signature and authorizes and validates instructions given just as an actual written signature does. 6.2 The Customer should ensure that no one can see them physically inputting the PIN. The PIN should not be written anywhere. The Customer is responsible for maintaining the confidentiality of a PIN and agrees not to disclose the PIN to anyone, including any Merchant Agent or employee of NCB or anyone claiming to represent NCB or NCB Customer Care Centre or to someone giving assistance on a technical helpdesk in connection with the service. NCB employees do not need a Customer’s PIN for any reason whatsoever. 6.3 A Customer who allows a third party to have access to a PIN does so at their own risk. Where a Customer allows a third party to have access to the PIN and the Mobile Money Account is compromised, NCB is not liable for any loss suffered by the Customer. 6.4 NCB shall not be held liable for any loss incurred by information disclosed/exchanged when carrying out an instruction from a Customer in respect of transactions between a Mobile Money Account and linked bank account, and NCB is fully indemnified and held harmless by the Customer in the same respect. 6.5 The Customer is responsible for protecting their Mobile Phone, devices or computer against computer viruses and other malware when they are used to access the Website and or their Mobile Money Account . NCB is not liable for any computer program or code, virus or malware and the Customer indemnifies NCB against any claims made in this regard.

SECURITY AND UNAUTHORISED USE. 4.4.1. Only one PIN Number shall be linked to a Customer’s Account. 4.4.2. Only the Customer shall be authorized to use the Mobile number linked to the Customer’s Account and the PIN Number. 4.4.3. The Customer shall be responsible for the safekeeping and proper use of his Mobile Equipment, PIN Number, and for all transactions that take place on account of using of the PIN Number.

MyCash shall not be liable for any loss suffered by the Customer if the Customer PIN is accessed or used by someone else. 1.10.3 The Customer must notify MyCash by calling +000000000000, email: xxxxxxx@xxxx.xx.xx or visit the nearest MyCash Kiosk when the Customer discovers that their MyCash card or lost or stolen. 1.10.4 The Customer is responsible for all transactions including the charges in respect of transactions done before the Customer blocks their MyCash Card. The Customer cannot claim money back from MyCash. The Customer indemnifies MyCash in full against any claims made in respect of such transactions.
SECURITY AND UNAUTHORISED USE. 7.1 You assume the full responsibility for the security, safekeeping and proper use of your Device and your Access Code(s) and for all Transactions that take place on your Account using your Access Code(s). 7.2 You are responsible for keeping your password, Access Code(s) and Online Account information confidential. In order to protect yourself against fraud, you should adhere to the following guidelines: i) Do not give out your account information, Password, or User ID; ii) Do not leave your device unattended while you are logged in the Bank’s platform; iii) Never leave your account information within range of others; and iv) Do not send privileged account information (account number, Password, etc.) in any public or general e-mail system. 7.3 The Bank will not be responsible if your Account is accessed or compromised because you fail to keep your Access Code(s) secure. You hereby undertake to indemnify us against any claims made for such Transactions. If you dispute that any purchase or withdrawal debited to your Account was authorised by you. We are entitled to assume that your instructions processed through the app are genuine when your Access Code(s) has been used. 7.4 You must ensure to keep your SIM card and mobile phone in secure/safe custody at all times. You will be solely responsible for the consequences in case you fail to adhere to this condition and/or in case of any authorised use of your mobile phone or SIM card. 7.5 At your own risk, you may send the Bank pre-recorded voice telephonic instructions on which the Bank will ably honor. The Bank will not be liable for acting on instructions sent through this medium originating from availed phone number and quoting your Access Code. 7.6 You have the sole responsibility to report any compromise of your Access Code(s) to us without delay through our CCC or your branch. Identity verification will be followed to prevent someone else from impersonating you. 7.7 The Bank will proceed to disable your Access Code(s), on receipt of this notification therefore all transactions/ instructions not yet executed will effective immediately be suspended. This notwithstanding, the Bank may exercise its rights under clause 4 of this Agreement.

We are not responsible if your account is accessed or compromised because you fail to keep your access code/pin safe. You hereby undertake to indemnify us against any claims made for such Transactions. If you dispute that any purchase or withdrawal debited to your Account was authorised by you, you will have to prove that it was not authorized by you. 3.2 We can accept your voice telephonic instructions without your written confirmation. This will be recorded and used as your confirmation to authorise us to follow your instructions. We will ask security related questions to confirm your identity when you phone our CCC to ensure your identity. 3.3 You are responsible for protecting your mobile phone against viruses when you use the Internet to access our website and Internet banking facilities. 3.4 You must report any compromise of your access code/pin to us without delay through our CCC or your branch. Identity verification will be followed to prevent someone else from impersonating you. 3.5 When you notify us to disable your access code, we are entitled to: 3.5.1 Reject all instructions received after such notifications. 3.5.2 Suspend the processing of all instructions not yet executed. 3.5.3 Reverse (if possible) all executed transactions with effect from such date and time as we may reasonable determine the unauthorized use to have. 3.5.4 Deactivate the access code/PIN without further notice. 3.6 Do not disclose an access code to any person including a member of our staff or CCC.

  • Unauthorised use We shall not be liable for any loss, liability or cost whatsoever arising from any unauthorised use of the Electronic Service. You shall on demand indemnify, protect and hold us harmless from and against all losses, liabilities, judgements, suits, actions, proceedings, claims, damages and costs resulting from or arising out of any act or omission by any person using an Electronic Service by using your designated passwords, whether or not you authorised such use.

  • Unauthorised Use of Intellectual Property a) The Supplier/Service Provider agrees to notify Transnet in writing of any conflicting uses of, and applications of registrations of Patents, Designs and Trade Marks or any act of infringement, unfair competition or passing off involving the Intellectual Property of Transnet of which the Supplier/Service Provider acquires knowledge and Transnet shall have the right, as its own option, to proceed against any party infringing its Intellectual Property. b) It shall be within the sole and absolute discretion of Transnet to determine what steps shall be taken against the infringer and the Supplier/Service Provider shall co-operate fully with Transnet, at Transnet’s cost, in whatever measure including legal action to bring any infringement of illegal use to an end. c) The Supplier/Service Provider shall cooperate to provide Transnet promptly with all relevant ascertainable facts. d) If proceedings are commenced by Transnet alone, Transnet shall be responsible for all expenses but shall be entitled to all damages or other awards arising out of such proceedings. If proceedings are commenced by both Parties, both Parties will be responsible for the expenses and both Parties shall be entitled to damages or other awards arising out of proceedings.

  • Data Security and Unauthorized Data Release The Requester and Approved Users, including the Requester’s IT Director, acknowledge NIH’s expectation that they have reviewed and agree to manage the requested controlled-access dataset(s) and any Data Derivatives of controlled-access datasets according to NIH’s expectations set forth in the current NIH Security Best Practices for Controlled-Access Data Subject to the GDS Policy and the Requester’s IT security requirements and policies. The Requester, including the Requester’s IT Director, agree that the Requester’s IT security requirements and policies are sufficient to protect the confidentiality and integrity of the NIH controlled-access data entrusted to the Requester. If approved by NIH to use cloud computing for the proposed research project, as outlined in the Research and Cloud Computing Use Statements of the Data Access Request, the Requester acknowledges that the IT Director has reviewed and understands the cloud computing guidelines in the NIH Security Best Practices for Controlled-Access Data Subject to the NIH GDS Policy. The Requester and PI agree to notify the appropriate DAC(s) of any unauthorized data sharing, breaches of data security, or inadvertent data releases that may compromise data confidentiality within 24 hours of when the incident is identified. As permitted by law, notifications should include any known information regarding the incident and a general description of the activities or process in place to define and remediate the situation fully. Within 3 business days of the DAC notification, the Requester agrees to submit to the DAC(s) a detailed written report including the date and nature of the event, actions taken or to be taken to remediate the issue(s), and plans or processes developed to prevent further problems, including specific information on timelines anticipated for action. The Requester agrees to provide documentation verifying that the remediation plans have been implemented. Repeated violations or unresponsiveness to NIH requests may result in further compliance measures affecting the Requester. NIH, or another entity designated by NIH may, as permitted by law, also investigate any data security incident or policy violation. Approved Users and their associates agree to support such investigations and provide information, within the limits of applicable local, state, tribal, and federal laws and regulations. In addition, Requester and Approved Users agree to work with the NIH to assure that plans and procedures that are developed to address identified problems are mutually acceptable and consistent with applicable law.

  • Publicity and Use of Trademarks or Service Marks 34.1 A Party, its Affiliates, and their respective contractors and Agents, shall not use the other Party’s trademarks, service marks, logos or other proprietary trade dress, in connection with the sale of products or services, or in any advertising, press releases, publicity matters or other promotional materials, unless the other Party has given its written consent for such use, which consent the other Party may grant or withhold in its sole discretion. 34.2 Neither Party may imply any direct or indirect affiliation with or sponsorship or endorsement of it or its services or products by the other Party. 34.3 Any violation of this Section 34 shall be considered a material breach of this Agreement.

  • Security; Reliance; Unauthorized Use The Fund will cause all persons utilizing the Software and System to treat all applicable user and authorization codes, passwords and authentication keys with extreme care, and it will establish internal control and safekeeping procedures to restrict the availability of the same to persons duly authorized to give Instructions. Custodian is hereby irrevocably authorized to act in accordance with and rely on Instructions received by it through the System. The Fund acknowledges that it is its sole responsibility to assure that only persons duly authorized use the System and that Custodian shall not be responsible nor liable for any unauthorized use thereof.

  • Notification of Xxxxxx and Unauthorized Release (a) Vendor will promptly notify the District of any breach or unauthorized release of Protected Data it has received from the District in the most expedient way possible and without unreasonable delay, but no more than seven (7) calendar days after Vendor has discovered or been informed of the breach or unauthorized release. (b) Vendor will provide such notification to the District by contacting Xxxxxx Xxx, Data Protection Officer, directly by email at xxxxxx.xxx@xxxxx.xxx or by calling 000-000-0000. (c) Vendor will cooperate with the District and provide as much information as possible directly to Xxxxxx Xxx, Data Protection Officer or his/her designee about the incident, including but not limited to: a description of the incident, the date of the incident, the date Vendor discovered or was informed of the incident, a description of the types of Protected Data involved, an estimate of the number of records affected, the schools within the District affected, what the Vendor has done or plans to do to investigate the incident, stop the breach and mitigate any further unauthorized access or release of Protected Data, and contact information for Vendor representatives who can assist affected individuals that may have additional questions. (d) Vendor acknowledges that upon initial notification from Vendor, the District, as the educational agency with which Vendor contracts, has an obligation under Section 2-d to in turn notify the Chief Privacy Officer in the New York State Education Department (“CPO”). Vendor agrees not to provide this notification to the CPO directly unless requested by the District or otherwise required by law. In the event the CPO contacts Vendor directly or requests more information from Vendor regarding the incident after having been initially informed of the incident by the District, Vendor will promptly inform Xxxxxx Xxx, Data Protection Officer or his/her designee.

  • No Unauthorized Use Provider shall not use Student Data or information in a Pupil Record for any purpose other than as explicitly specified in this DPA.

Persons who are not currently a student, member of staff, contractor or registered user of the Institution, but who are permitted to access the Institution's information services from computer terminals or otherwise within the physical premises of the Institution ["Walk-In Users"] are also deemed to be Authorised Users, only for the time they are within the physical premises of the Institution.
