Service Fee Adjustments. The parties agree that fees shall be adjusted annually. No adjustment shall take place any earlier than 12 months from the effective date of the Agreement. Fee adjustments shall be effective each January 1 or July 1, whichever date occurs first after the one year anniversary of the Agreement. The standard employed shall be the Consumer Price Index, US average for all Consumers (“CPI-U”) as determined by the Bureau of Labor Statistics, using the most recent November 30 CPI-U for January adjustments and May 31 CPI-U for July adjustments. The amount of inflation/deflation for the prior year shall be calculated by dividing the most recent CPI-U (November 30 or May 31, as appropriate) by the CPI-U as of the effective date of this contract. This inflation/deflation factor shall then be multiplied by the respective fees stated herein, rounding to the nearest ten (10) dollars.

Service Fee Adjustments. If Service Fees are set pursuant to Subsection (b)(1) or Subsection (b)(2), then those Service Fees may be adjusted as provided in Subsection (c). Upon written request by Franchisee to the County Board for a Service Fee adjustment submitted no earlier than July 1st and no later than October 1st prior to the commencement of each new Contract Year, Franchisee’s Service Fees for Franchise Services will be adjusted, upward or downward, annually, effective January 1st of each Contract Year, in the manner described provided in Subsection (c). The County Board may also (but is not obligated to) act on its own initiative in the event Franchisee declines to request an adjustment to its Service Fees, and adjust Franchisee’s Service Fees in the manner described below. Franchisee will provide written notice to each Customer in a form approved by County, of annual increases, whether initiated by Franchisee or by the County Board, at least six (6) weeks prior to their implementation.
Service Fee Adjustments. The amount of the Service Fee shown above will not be adjusted during the Initial Term of this Agreement. AED123 may adjust the amount of the Service Fee to be charged and paid during any Renewal Term, provided that AED123 notifies Customer of such Service Fee adjustment at least 60 days before the start of such Renewal Term. Customer retains the option to cancel automatic renewal of this Agreement after receiving notification of a Service Fee adjustment (as outlined in Section 7).
Service Fee Adjustments. Securitas shall be entitled to adjust the Service Fee during the term of this Agreement upon thirty (30) days written notice to the Customer in case Securitas’ costs for the provision of the Services increase due to (i) increased labour costs or costs related to any equipment and tools provided, (ii) changes in insurance premiums and/or (iii) changes in legislation or regulations relating to the Services. Securitas is also entitled to adjust the Service Fee once a year by a percentage rate of an average inflation in the Czech Republic throughout the past calendar year, published by the Czech Statistics Authority, starting in the month following their publishing. Securitas will inform the Customer about the change in the cost in writing and in advance.

[***] percent ([***]%) of the Services Fee shall be adjusted annually, up or down, during the term of this Agreement, for the prospective calendar year, the first prospective calendar year being 2012, based on the percentage change in the annual average in the “Consumer Price Index for All Urban Consumers (CPI-U) : U.S. city average - All items “ which occurred in the preceding Calendar Year as published by the United States Department of Labor, Bureau of Labor Statistics for the previous calendar year. B. The Variable Fee shall be subject to adjustments in accordance with Exhibit “D”. Each Variable Fee adjustment will occur within sixty (60) days of the end of each calendar year 2011 and 2012 only, taking into account the Actual Costs incurred by Buyer as of such dates, and the estimated capital costs to be incurred by Buyer in completing Buyer’s Gathering System, as then anticipated, but in any event as necessary to complete the connection of all of the xxxxx subject to Seller’s Well Connection Commitment and the remaining facilities described on Exhibit “C”. In order to calculate any Variable Fee adjustments, the highlighted portions of Exhibit “D” are subject to modification to reflect Actual Costs expended. Changes in insurance premiums. 6.2.4. Changes in legislation or regulations relating to the Services.

Service Fee Adjustments. The Service Fee shall be the mutually agreed upon base price as identified by all executed Order Forms, less any applied discounts. Upon annual review, the Service Fee shall be adjusted to reflect the appropriate Service by Customer.

Service Fee Adjustments. Service Fees will be prorated (“Prorated Fees”) for Services purchased during a Billing Period. No amounts will be refunded with respect to cancellations or reductions of Services during a Billing Period. Right Networks will refund fees on a prorated basis to the extent it terminates your Services during a Billing Period without cause.
