Software Fees. All known software fees are included in the above Service fees mentioned in section 3.1. Should additional unforeseen software be identified as a value-add, the parties will in good faith determine the additional fee and document as an amendment to this Task Order agreement.
Software Fees. 3.4.1 MIPS SOURCE CODE SOFTWARE. WEITEK shall pay to MIPS, MIPS then current standard license fees for each license of MIPS Source Code Software which WEITEK wishes to obtain as set forth on the Source Code Use License Agreement. WEITEK may license MIPS Source Code Software on a single user, site or corporate basis.
Software Fees. Subscriber shall abide by the payment requirements established during the sale of the Software and referenced in the sales quote (“Software Fees”).

(A) MANAGER ACKNOWLEDGES THAT (I) IT CURRENTLY HAS AN INDEPENDENT LICENSING ARRANGEMENT FOR SOFTWARE IN EFFECT ON THE DATE OF THIS ADDENDUM THAT CONTINUES SO LONG AS MANAGER IS AN AFFILIATE OF SPRINT PCS, (II) SUCH INDEPENDENT LICENSING ARRANGEMENT DOES NOT NECESSARILY EXTEND TO FUTURE IMPROVEMENTS UPON OR EXPANSIONS OF SUCH SOFTWARE, OR INCLUDE ANY NEW SOFTWARE DEVELOPED BY OR FOR SPRINT PCS IN CONNECTION WITH PROGRAM REQUIREMENTS AND (III) SPRINT PCS ADMINISTERS THE TESTING AND IMPLEMENTATION OF THE SOFTWARE INTO THE SERVICE AREA NETWORK.

Software Fees. 6.1.2.1 100% of the first Software Fee for the LWW Software Package (wireless features only) as described Section 2.5 of in Annex 1 applicable to each Switch will be invoiced upon the earlier of (i) the commercial, revenue-producing service of each Switch, or (ii) ninety (90) days after Buyer's Acceptance of Sellers Installation of such Switch pursuant to Schedule A of Annex 2. Thereafter, annual Software Fees for any such Switch will be invoiced annually on the anniversary date of the first such invoice.
Software Fees. (a) Server Software licensing and use fees are defined by a separate pricing offer from Comtrend to Customer and Customer’s purchase order once accepted by Comtrend and non electronic service agreement and terms of use is signed by both parties.
Software Fees. (a) Where any Software is supplied, the Software Fees will be specified in the Quote. The Software Fees may be determined based on the number of End Users, the functionality and customisation of the Software, the level of administrative privileges and support that the Customer requests Rapid Electronics to provide, and the period to which the fees relate (each a Billing Period), as well as any other relevant matters set out in the Quote. If no Software Fees are specified in the Quote for the relevant Software and the Quote does not provide that the Software Fees are included in the Fees for the other Products to be supplied, then the Customer will be charged Software Fees at Rapid Electronics’ current rates as reasonably determined by Rapid Electronics.
Software Fees. 4.1.1 Customer will pay to Experlogix the Fees set forth in the applicable Software Order (“Software Fees”). Except as otherwise provided in an applicable Software Order, each Software Order is non-cancellable, and all sums paid are non-refundable. Software Fees shall be due at the beginning of the Software Initial Term and within ninety (90) days of Experlogix issuing the invoice for the Software Renewal Term. Additional Software Fees for adding additional Users will be paid by Customer upon receipt of an invoice for such additional Users by Experlogix, and such additional Software Fees will be prorated through the end date of the then-current Software Initial Term or Software Renewal Term. Experlogix may increase Fees for any Software Renewal Term provided such increase does not become effective until the end of the then-current Software Initial Term or Software Renewal Term.
4.1.2 Customer acknowledges and agrees that Software Fees are calculated based on normal usage of the Services in a manner consistent with its intended purposes as described in the Documentation. Unless set forth otherwise in an Order, if Customer’s use of the Services results in CPU or bandwidth usage, or usage of any metered resource paid for by Experlogix through its cloud provider, that significantly exceeds average levels (collectively, “Usage”), Customer may incur additional fees (“Hosting Fees”). If Customer approaches such Usage level, Experlogix shall use reasonable efforts to notify Customer in writing, providing details of the excess Usage and the potential Hosting Fees associated therewith. Customer shall have (30) days from the date of notification to either (a) reduce its Usage to normal levels or (b) agree to the payment of the Hosting Fees, in which case Experlogix shall invoice Customer for such additional Hosting Fees, which shall be due and payable within thirty (30) days of Customer’s receipt of such invoice.
