Standards of Accommodation. J.3.1. The Contractor shall if required to provide services in homes accommodating three (3) to six (6) young people and above contact the Waltham Forest Hosing Department regarding House of Multiple Occupation (HMO) criteria and application process / certification. J.3.2. At all times, the Contractor shall ensure that the accommodation provided for a child or young person complies with the requirements of all applicable law regarding health and safety and the Health and Safety Policy of the Participating Authority as advised to the Contractor from time to time. For the avoidance of doubt this shall include but not be limited to all current law in relation to public health, the legal requirements in relation to the safety of furniture and furnishings, all relevant fire precautions, fire safety regulations, and legislation and any other national and local regulations as to the safety and standards of housing. J.3.3. The Contractor shall adhere to all Health and Safety Regulations and Guidelines and place smoke and carbon monoxide detectors (for gas appliances) in the accommodation. Additionally, the Contractor shall provide fire doors, extinguishers, fire blankets, no smoking and fire exit signs. Regular inspection by the Fire Officer will be certified for inspection where appropriate. J.3.4. The Contractor shall ensure that accommodation has an energy efficiency rating of at least an E on the Energy Performance Certificate, to ensure minimum standards are met. J.3.5. The Contractor shall ensure that the accommodation has a satisfactory up to date NICEIC electrical safety certificates and gas safety certificates where appropriate. J.3.6. A copy of Energy Performance Certificates, NICEIC electrical safety and gas certificates shall be made available by the Contractor for inspection purposes. J.3.7. The Contractor shall ensure that the accommodation is fully furnished with suitable furniture and equipped for supported living with the following items to be included as a minimum (for Group Living accommodation, some of these rooms and facilities will be communal): J.3.8. The Contractor shall be responsible for the repair, maintenance and replacement of such furniture and equipment where appropriate. The Contractor shall also be principally responsible for the repair and maintenance of the property. J.3.9. Standards of Accommodation. The Supplier declares that it will ensure a humane living and housing situation in the event that it places employees in apartments or other types of accommodation.
Standards of Accommodation. The EMPLOYER will provide Artists with hotel information five (5) weeks prior to tour. Accommodation arrangements shall be discussed in Joint Committee prior to booking, if possible, or with the AGMA delegates, if time is of the essence. In either case, the final decision rests with the EMPLOYER. The following criteria shall be met in order to satisfy the adequacy requirements for hotel accommodations: Hotel accommodations shall be no less than three (3) star rated, shall be fully functional, and to the best of the EMPLOYER’s knowledge shall not be under renovation during the Artist’s stay. Hotel accommodations shall be of such nature that Artists can get adequate rest to prepare for their duties on tour. This is to include accessibility to food (especially late night dining), which may include but not be limited to 24-hour room service and full bath tub. Furthermore, hotel accommodations shall, whenever possible, be no more than one-half (1/2) mile from the theatre. If this is not possible, EMPLOYER shall make transportation available at appropriate times (e.g. permitting time for undressing and make-up removal) or reimburse Artists for reasonable transportation expenses.

  • Standards of Conduct Whenever the Member is required or permitted to make a decision, take or approve an action, or omit to do any of the foregoing, then the Member shall be entitled to consider only such interests and factors, including its own, as it desires, and shall have no duty or obligation to consider any other interests or factors whatsoever. To the extent that the Member has, at law or in equity, duties (including, without limitation, fiduciary duties) to the Company or other person bound by the terms of this Agreement, the Member acting in accordance with the Agreement shall not be liable to the Company or any such other person for its good faith reliance on the provisions of this Agreement. The provisions of this Agreement, to the extent that they restrict the duties of the Member otherwise existing at law or in equity, replace such other duties to the greatest extent permitted under applicable law.
