Standards of Personnel. 14.1. Appraiser acknowledges that the Federal Government has declared public water systems, including Owner’s, to be critical infrastructure essential to the continued operation of the government and the nation. 14.2. Appraiser acknowledges that Owner’s water and wastewater operations are governed by numerous federal and state statutes and regulations, and subject to regulation by numerous federal and state agencies. 14.3. Appraiser acknowledges that, among other things, Owner provides retail water and wastewater service to the public, as authorized and regulated by public utility commissions, so that Owner has a public-service obligation to provide safe and affordable water and wastewater service to the public. 14.4. Appraiser will conduct, or will have conducted, a background check on each of its employees or individual subcontractors before the employee or subcontractor performs any function or activity under this Agreement that involves access to Owner’s Confidential Information or on-site work at any of the Owner's facilities. The background check conducted by Appraiser will include at least the following: 14.5. Appraiser’s review of this information will endeavor to: • Authenticate the identity of the individual; • Insure that data is consistent with an individuals stated history and current status; • Uncover any discrepancies; • Reveal any criminal history; and • Uncover any other pertinent information tending to establish that the individual may represent a security risk to Owner’s personnel, facilities , or Owner’s responsibility for the public safety and the providing of safe and adequate utility services to its customers. 14.6. Upon request, Appraiser will make available for Owner’s review, the documentation and results of the background check with respect to any employee of Appraiser performing any function under this Agreement. Owner will not retain such records or documentation and any findings from its review will be confidential. 14.7. Appraiser is expected to conform its business dealings with the Owner in accordance with the underlying principles of the Owner’s Code of Ethics, a copy of which is available on the Owner’s website at xxxx://xxx.xxxxxxx.xxx.

Standards of Personnel. 17.1 As a condition of MERCK entering into this AGREEMENT, the following standards will be required of SUPPLIER. SUPPLIER warrants that all personnel assigned to this account will: a. Demonstrate compliance with Federal, state and local laws governing US residency or registry for employment eligibility (e.g. submission of proper documentation confirming US citizenship or legal alien status and/or INS Form I-9). b. Not have been convicted of any crime that reflects on the qualifications of the individual to perform the job assignment at MERCK. 17.2 In addition, SUPPLIER will: a. Cause all staffing to be in compliance with established Equal Employment Opportunity standards for the affected geographic areas. b. Require that all assigned personnel pass a pre-employment professional reference check performed by SUPPLIER. c. MERCK reserves the right to reject for any reason whatsoever any personnel assigned to MERCK by SUPPLIER. SUPPLIER shall as soon as possible thereafter provide a replacement satisfactory to MERCK for which approval shall not be unreasonably withheld. d. The conduct of all personnel assigned hereunder shall be governed by MERCK’S policies and procedures as shall be in effect from time to time.

  • Review of Personnel Files Every member shall be allowed to review any of his/her personnel files except "confidential law enforcement records" and "trial preparation records" as defined in Ohio Revised Code Section 149.43 at any time, upon request and reasonable notice. Such request shall be made to the supervisor directly responsible for maintenance of such files. Review of the files shall be made in the presence of such supervisor or the supervisor's designated representative. For the Division master personnel file, the request shall be made to the member's Subdivision Deputy Chief or his/her designated representative. Any member, or the member's Lodge representative, may copy documents in the member's file. The City may levy a charge for such copying, which charge shall bear a reasonable relationship to actual costs. A member will be notified in writing any time records within his/her personnel, background, IAB, and/or payroll file(s) are requested, as a public records request pursuant to Ohio Revised Code Section 149.43, provided the City determines that the request is proper under applicable law. A member may request copies of any records provided under this paragraph, and these copies shall be provided at no cost to the member.

  • Removal of Personnel The CONSULTANT agrees, within thirty (30) calendar days of receipt of a written request from the COUNTY, to promptly remove and replace the CONSULTANT'S Project Director, or any other personnel employed or retained by the CONSULTANT, or personnel of the sub-consultants or subcontractors engaged by the CONSULTANT to provide and/or perform services and/or work pursuant to the requirements of this Agreement, who the COUNTY shall request, in writing, be removed, which request may be made by the COUNTY with or without cause.
