STANDING DOWN AN EMPLOYEE. 2.15.1 The employer shall have the right to deduct payment for any day or part thereof where an employee cannot be usefully employed because of: a) any strike, or any stoppage of work by any cause for which the employer cannot reasonably be held responsible. b) as a result of the employee's unavailability for duty due to failure to satisfactorily pass a drug or alcohol test c) major loss or failure of service equipment or machinery for which the Company has no control, however, all reasonable attempts will be made by the employer to find alternate productive work or offer the use of annual leave or long service leave provisions where available. 2.15.2 The stand down period is counted as a period of service and does not break an employee's continuous service with the Company.

STANDING DOWN AN EMPLOYEE. (a) The Employer shall have the right to deduct payment for any day or part thereof where an Employee cannot be usefully employed because of: (1) Any strike, or stoppage of work by any cause for which the Employer cannot reasonably be held responsible; (2) As a result of the Employee's unavailability for duty due to failure to satisfactorily pass a drug or alcohol test; (3) The major loss or failure of service equipment or machinery for which the Employer has no control, however, all reasonable attempts will be made by the Employer to find alternate productive work, or other use of annual leave provisions where available. (b) An Employee who does not comply with a lawful management direction or does not sign that they will work in accordance with the Employer’s Policies or Procedures may be suspended by the Employer until they agree to comply with the management direction, policy or procedure. (1) The suspension period shall be counted as a period of service and does not break an Employee's continuous service with the Employer. (2) The suspension of an Employee may be with or without pay at the sole discretion of the Employer.

  • Where an Employee (a) at the maximum rate of a salary range is promoted, a new anniversary date is established based upon the date of promotion; (b) at a rate less than the maximum in the salary range is promoted and receives a promotional increase: (1) greater than a one-step increase, a new anniversary date based on the date of promotion is established; (2) of one step or less, the existing anniversary date is retained. 7.2.1 Where the duties of an employee are changed as a result of reorganization or reassignment of duties and the position is reclassified to a class with a lower maximum salary, an employee who occupies the position when the reclassification is made is entitled to salary progression based on merit to the maximum salary of the higher classification including any revision of the maximum salary of the higher classification that takes effect during the salary cycle in which the reclassification takes place. 7.2.2 An employee to whom Article 7. 2.1 applies is entitled to be appointed to the first vacant position in his or her former class that occurs in the same administrative district or unit, institution or other work area in the same ministry in which he or she was employed at the time the reclassification was made.

  • Death of an Employee All rights to accident pay will cease on the death of an Employee.

Therefore, the Executive agrees that for the period commencing on the date of this Agreement and ending on the first anniversary of the termination of the Executive’s employment hereunder (such period is hereinafter referred to as the “Restricted Period”) with respect to any State in which the Company is engaged in business during the Employment Term, the Executive shall not participate or engage, directly or indirectly, for himself or on behalf of or in conjunction with any person, partnership, corporation or other entity, whether as an employee, agent, officer, director, partner or joint venturer, in any business activities if such activity consists of any activity undertaken or expressly contemplated to be undertaken by the Company or any of its subsidiaries or by the Executive at any time during the last three (3) years of the Employment Term. The foregoing restrictions contained in this Section 7(a) shall not prevent the Executive from accepting employment with a large diversified organization with separate and distinct divisions that do not compete, directly or indirectly, with the Company or any of its subsidiaries or affiliates, so long as prior to accepting such employment the Company receives separate written assurances from the prospective employer and from the Executive, satisfactory to the Company, to the effect that the Executive will not render any services, directly or indirectly, to any division or business unit that competes, directly or indirectly, with the Company or any of its subsidiaries or affiliates. During the Restricted Period, the Executive will inform any new employer, prior to accepting employment, of the existence of this Agreement and provide such employer with a copy of this Agreement.

  • Regular Employee Seniority for a regular employee is defined as the length of the employee’s continuous employment (whether full-time or part-time) from the date of commencement of regular employment, plus any seniority accrued, while working as a casual employee of the Employer.

  • Key Employee Key employee means any employee or former employee (including any deceased employee) who at any time during the plan year that includes the determination date was an officer of the employer having annual compensation greater than $130,000 (as adjusted under Section 416(i)(1) of the Code for plan years beginning after December 31, 2002), a 5-percent owner of the employer, or a 1-percent owner of the employer having annual compensation of more than $150,000. For this purpose, annual compensation means compensation within the meaning of Section 415(c)(3) of the Code.
