Statement of Issues. The Arbitrator shall be limited to deciding the issues submitted. If the parties cannot agree upon a statement of issues, the Arbitrator shall determine the issues. In cases of procedural disputes, the Arbitrator shall be empowered to rule on such disputes.
Statement of Issues. 1 For some years in Australia there has operated a payment system known as EFTPOS, an acronym for electronic funds transfer at point of sale. Consumers who hold a cheque or savings account at a bank or other financial institution (called “the issuer”) receive a programmed plastic card called a debit card. When purchasing goods or services from a merchant the cardholder produces the debit card. The authority of the cardholder to use the debit card is confirmed by entry of his or her personal identification number (PIN) on a terminal at the point of sale. The merchant then transmits details of the sale over a secure electronic network to the merchant’s bank (referred to as “the acquirer”). The acquirer then by electronic message checks the cardholder’s account with the issuer and a message for authorisation or decline of the proposed purchase is returned by the acquirer to the merchant. The whole process is completed within a few seconds. The issuer debits the cardholder’s account and the acquirer credits the merchant’s account, usually via overnight settlement of all transactions processed by the merchant. Often a merchant will provide cash (referred to as “cash out”) to the cardholder, and sometimes even though no purchase is made. 2 EFTPOS facilities are available at some 430,000 retail outlets throughout Australia. There are over 100 issuers and in the order of ten acquirers.
Statement of Issues. [33] I will begin with the issue of the enforceability of the tariff. The question of fair dealing only arises if the tariff applies to York. It is only if a final tariff is “mandatory” that York must rely on its Guidelines to show that compliance with them is fair dealing, a user’s right. [34] I propose to deal with Access Copyright’s claim by first reviewing some of the concepts which will recur in the discussion. I will then review the statutory provisions in issue in Vigneux and trace their legislative development through to the Copyright Modernization Act. This review will show that the basic structure set out in the 1936 amendments has been preserved throughout this legislative history which supports the conclusion that the legislative intent has also remained the same. Similarly, the use of the expression “licensing schemes” throughout this history also suggests a continuity of purpose. I will deal with various ancillary arguments as they arise in the course of this legislative history. [35] As noted earlier, I will deal with Xxxx’s Guidelines by examining the Federal Court’s reasoning and the parties’ submissions in light of the teachings of the three relevant Supreme Court decisions.

Statement of Issues. 7.1. The parties must provide the Mediator and the other parties to the dispute with a Statement of Issues which shall be uploaded via the ADR Xxxxxxxx Expedited Mediation booking system. The applicant requests Planning Commission approval of a Community Benefit Agreement (CBA) which would allow increased FAR and residential density in exchange for community benefits in the form of privately owned publicly accessible open space, and offsite improvements including full street reconstruction on portions of N. Broadway and Xxxxxx Way. This is a “points based” CBA which requires approval from the Planning Commission, pursuant to the Community Benefits Program adopted by the City Council on February 2, 2021. The CBA application is separate from and a precursor to a development application for Design Review of a mixed-use project. The CBA will help establish the building envelope to which the project will be designed. Staff recommends the Planning Commission adopt the proposed resolution approving the CBA for 1910 North Broadway (Attachment 1).
