TRAIL MAINTENANCE. The CLUB agrees to assist the STATE with the maintenance of the TRAIL. Maintenance shall include, but not be limited to, signage, routine inspection, installation, repair, and replacement of bridges and culverts, removal of rocks and stumps, placement of gravel and natural fill, smoothing the trail surface, installation of broad based dips, water bars and ditches, removal of fallen trees, cutting back vegetation encroaching on the TRAIL to assist with safe winter grooming practices, and grooming of the TRAIL. a. The CLUB may apply for Grant-In-Aid (GIA) and/or Recreational Trails Program (RTP) grant funds in order to complete maintenance of the TRAIL. The CLUB is also permitted to solicit and receive donations on behalf of, and for use in, the maintenance of the PROPERTY. Third party donations shall not constitute a claim or interest within the PROPERTY. The CLUB shall notify all donor(s) of this policy in writing. b. The STATE agrees that the CLUB is a maintenance partner of the STATE, and as such, the STATE agrees that the CLUB shall not be responsible for providing repairs on the PROPERTY caused by unexpected catastrophic events, natural or otherwise, damages caused by others, major TRAIL damages, or impacts caused by the public use of the TRAILS. Such significant repairs would be done in partnership between the parties, including, but not limited to, shared labor, materials, and expenses. c. The CLUB agrees to maintain all necessary safeguards for the safety of the public and CLUB volunteers. The CLUB shall not be liable for personal injury or property damage from construction, maintenance, or trail improvements for public recreational use, pursuant to RSA 508:14, II, in the absence of gross negligence or willful or wanton misconduct. d. The CLUB agrees to maintain a record of all persons involved in volunteer work on the PROPERTY. Said record will contain the volunteer’s full name, dates and hours of volunteer work, and type of volunteer work performed to enable the protections under RSA 508:17. e. The CLUB agrees to maintain all equipment, to include but not be limited to, chainsaws, handsaws, limb saws, excavators, backhoes, rock xxxxx, graders, groomers, and drags, utilized for trail work on the PROPERTY, in proper operating condition with all safety devices functioning. f. TRAIL MAINTENANCE. The CONTRACTOR agrees to assist the STATE with the maintenance of the TRAIL. Kiosks: There are several kiosks located at various points along the TRAIL. These are permanently fixed to the TRAIL and are the property of the STATE. The CONTRACTOR shall not remove or alter these kiosks without prior approval from the STATE. The CONTRACTOR may perform regular maintenance and upkeep to the kiosks. The CONTRACTOR shall not add any additional kiosks to any part of the TRAIL without prior approval from the STATE. Requests for additional kiosks shall be made to the STATE through the CONTRACTOR’s Annual Work Plan. Any additional structures that were installed to the TRAIL prior to this AGREEMENT are subject to removal at the STATE’s discretion. No other structures may be installed to the TRAIL without prior approval from the STATE. b. TRAIL MAINTENANCE. As with trail adjustments and development, trail maintenance will be outlined and prioritized in the SMBA’s Annual Operating Plan. Routine trail maintenance, as outlined in the RSTBC partnership agreement, should be considered in the development of the Annual Operating Plan. Annual inspections of existing trails and Technical Trail Features (TTFs) must be completed, including a description of trail/TTF condition and maintenance requirements. These inspections are submitted to RSTBC each year as a requirement of the partnership agreement and inform the maintenance requirements outlined in the SMBA’s Annual Operating Plan. The Trail Management Subcommittee is responsible for ensuring the annual inspects occur each year. Any trail maintenance that is conducted in the SMBA trail networks must follow the SMBA standards outlined below, including that conducted by the Adopt-A-Trail Program and the Trail Brigade. Trail maintenance standards for the SMBA are adapted from IMBA and Whistler trail standards and conform with standards outlined in the RSTBC partnership agreement. At the beginning of each season, these standards shall be reviewed by anybody participating in maintenance of the trails throughout the year. TRAIL MAINTENANCE. City will maintain the trail consistent with other non- motorized trails that are part of the City’s bicycle and commuter network. This maintenance may include, but is not limited to, snow plowing, repairing the surface of the trail, managing weeds and installing fences or signs, or reconstructing the trail as needed within the Trail Easement.

TRAIL MAINTENANCE. Routine trail maintenance activities will be performed on existing trails to remove minor damage, defects or hazards and restore drainage and erosion control features. Preventative maintenance will also be performed to restore existing drain and erosion control features. Maintenance may include items such as the following although this list is not all-inclusive: clearing, removing slough and berm, filling ruts and troughs, grading tread material, erosion mitigation, bridges, removal of sediments/debris from drainage features and culverts, water bars and grade dips, incised trail, unsafe conditions, etc. Will be considered as included in Contract unit price bid per LINEAR FOOT in accordance with these specifications and no additional compensation will be allowed thereafter.

TRAIL MAINTENANCE. The City shall be responsible for routine cyclical and long-term operation and maintenance of the Xxxxxxxx segment of the trail within County property, including lighting, irrigation, drainage, snow removal, sweeping, signing, striping and repaving, and other regular maintenance items. a. The City shall be responsible for long-term operation and maintenance of the Playfair segment of the trail within City property, including lighting, irrigation, drainage, snow removal, sweeping, signing, striping and other regular maintenance items. The City shall be responsible for asphalt repairs in the case that City equipment damages the asphalt. The City shall not be responsible for routine asphalt repairs or cyclical asphalt maintenance or replacement of this trail segment.
TRAIL MAINTENANCE. The County shall be responsible for routine cyclical and long-term operation and maintenance of the Fairway/Raceway segment of the trail within County property, including lighting, irrigation, drainage, snow removal, sweeping, signing, striping and repaving, and other regular maintenance items. a. The County shall be responsible for timely asphalt repairs and replacement of the Playfair segment of the trail within City property – including asphalt patching, crack sealing, seal coating, and overlay. The County shall ensure the asphalt trail tread (surface) is reasonably smooth and uniform and in good repair to prevent damage to City equipment when snow plowing, sweeping, or painting. In event the trail’s asphalt surface becomes unsuitable, for noted maintenance activities or user safety the county shall provide for those services until repairs are effected.
TRAIL MAINTENANCE. The Local Development Company and Trail Management Organisation should together review the Trail Management Plan for the trail once it is approved to join the Walks Scheme and as required thereafter. The plan should reference the sections on the Walks Scheme which will be maintained under work plans within the Walks Scheme framework. In addition, the plan will identify the work to be done on the rest of the trail (not covered by the Walks Scheme) and responsibility for work to be completed will be by local agreement between the Trail Management Organisation and Local Development Company. The Trail Management Plan should include details of the maintenance to be done such as litter picking, raking of leaves, filling of potholes, pruning back of overhanging or encroaching branches and vegetation and the maintenance of structures such as xxxxxx, footbridges, gates etc. It should also include details of who will do the work. The Local Development Company and Trail Management Organisation shall keep written dated records of any works carried out that they are responsible for. In the case of the sections of the trail on the Walks Scheme, the section work plans will form the basis for these records. The records will be reviewed by Sport Ireland during trail inspections and may be required as evidence in the event of a claim for injury by a member of the public. The Trail Management Plan should be reviewed and amended as appropriate. This should be done in consultation with the Trail Management Organisation once the trail is approved to join the Walks Scheme. The Local Development Company and Trail Management Organisation should agree within the Trail Management Plan who assumes responsibility for the maintenance and upkeep of the trail and trail structures on all other sections of the trail which are not included on the Walks Scheme. Trail Management Organisations may submit maintenance and trail improvement proposals for consideration to the Local Development Company. These must be given due consideration, subject to available budgets and value for money assessment, and all requests must be responded to in writing or via email within one month. The Local Development Company should notify the Trail Management Organisation in advance of any contractor commencing previously agreed work on a Walks Scheme trail.
