Supply of Fuel. 5.1 The Contractor shall provide prompt delivery of fuel oil once ordered so as to ensure at all times the usable fuel level in the Company storage tanks is adequate to meet the fuel consumption for at least two calendar weeks.
5.2 In the event that the Contractor fails to deliver the ordered fuel on time due to whatsoever reasons, it is the onus of the Contractor to provide at no extra charge alternative fuel of accepted quality to enable continuous operation of the station until the delivery of the ordered fuel takes place.
5.3 In order to ensure reliability of fuel supply to all stations, the Company intends to establish alternative fuel suppliers for all stations. The Company reserves the right to purchase from alternative fuel suppliers whenever there is failure by the Contractor to deliver. The Contractor shall reimburse to the Company any excess amount incurred as compared to the Contractor’s fuel price and delivery charges.

Supply of Fuel. 9.01 Throughout the Co-operation Period INTERNATIONAL POWER shall at all times supply and deliver all MSW fuel and start up electricity required by NAANOVO and necessary for the WTE plant to generate the electricity required to be produced by it pursuant to Clause 10.
9.02 The transportation cost of the fuel to be supplied by INTERNATIONAL POWER pursuant to Clause 9.01 shall be at INTERNATIONAL POWER's expense.
9.03 All fuel and start up electricity to be supplied by INTERNATIONAL POWER shall be of the quality and supplied and delivered in the manner described in the Fourth Schedule.
9.04 All fuel shall be tested as provided in the Fourth Schedule, and NAANOVO shall, at all times, be entitled to reject any fuel if the results of any test relating to it show that it does not comply with the Fuel Specifications but INTERNATIONAL POWER shall not have any liability to NAANOVO for damage to the WTE plant resulting from the fuel not complying with the Fuel Specifications.
9.05 INTERNATIONAL POWER shall when requested by NAANOVO ensure that at all times the necessary fuel stocks required by NAANOVO are stored within WTE plant or are available for immediate delivery to the Site.
Supply of Fuel. Free supply of coal on the prescribed norms will continue. However, an endeavor will be made to reimburse the cost of about 14.5 kg., of Liquefied Petroleum Gas (L.P.G.) per month. The company will make efforts to arrange supply of gas in phased manner.
Supply of Fuel. The existing system of supply of free coal will continue to the employees in the collieries/establishments. However, steps will be taken to substitute coal with gas to the extent possible. Modalities will be decided jointly as company level.
Supply of Fuel. 9.01 Throughout the Co-operation Period NAPOCOR shall at all times supply and deliver all fuel and (except in the case of a Black Start) start up electricity required by HOPEWELL and necessary for the Power Station to generate the electricity required to be produced by it pursuant to Clause 10.
9.02 The cost of the fuel to be supplied by NAPOCOR pursuant to Clause 9.01 shall be for NAPOCOR's account.
9.03 All fuel and start up electricity to be supplied by NAPOCOR shall be of the quality and supplied and delivered in the manner described in the Fourth Schedule.

Lessee and Lessor agree that, because of Lessee’s exclusive use of the Premises and the conditions and restrictions on Lessee’s Activities imposed by this Amendment 1, there will not be fuel sales on the Premises, therefore Section 13 is not applicable and shall be deleted in its entirety and replaced with the phrase “Section 13 no longer applicable”.
