TERMS OF ELIGIBILITY Sample Clauses

TERMS OF ELIGIBILITY. As conditions precedent to Mirantis’ obligations under this Section, Customer must: (i) be current in the payment of all fees at the time the Claim (as defined below) is brought; (ii) not be in litigation with, or in receipt of alleged infringement from, a party against whom relief is sought when purchasing Subscription Services; (iii) notify Mirantis promptly, but in no event later than ten (10) days of receipt of any Claim for which relief is sought under this Section; (iv) allow Mirantis to solely control and conduct the defense of the Claim with counsel of its choice and to settle any such Claim at Mirantis’ sole discretion; (v) provide reasonable cooperation with Mirantis in the defense of the Claim; and (vi) has complied with the terms of the Agreement and this Section. For the purposes of this Section 11, “Covered Software” means the Mirantis Hardened Packages, as defined in an Exhibit, available for download through the Mirantis Portal.
TERMS OF ELIGIBILITYAn applicant who is an accredited professional designer, including but not limited to an interior designer, architect or home xxxxxx (see professional organization list below), will be eligible for participation in this Design Trade Program (and referenced herein as a “Member”) upon approval by the Company after presentation of the following:
TERMS OF ELIGIBILITY. (a) Eligibility begins: For eligible new employees, eligibility begins the first day of the month following the waiting period. (b) For eligible new employees, the waiting period is 30 days. (c) For employees enrolling their Dependents: Dependent children are eligible through the end of the month in which they attain age 26, regardless of student status, or if age 26 and beyond, to the date they lose eligibility due to the Dependent’s inability to meet all of the requirements contained in Section 3.1 (b) of the Master Group Contract.
TERMS OF ELIGIBILITY. As conditions precedent to Mirantis’ obligations under this Section 11 (Mirantis Assurance), Customer must: (i) be current in the payment of all fees at the time the Claim (as defined below) is brought; (ii) not be in litigation with, or in receipt of alleged infringement from, a party against whom relief is sought when purchasing Subscription Services; (iii) notify Mirantis of the nature of the claim in sufficient detail promptly after, but no later than ten (10) days of receipt of any Claim for which relief is sought under this Section 11; (iv) allow Mirantis to solely control and conduct the defense of the Claim with counsel of its choice and to settle any such Claim at Mirantis’ sole discretion; (v) provide reasonable cooperation with Mirantis in the defense of the Claim; ; (vi) acts to mitigate Mirantis’ risk and exposure as a result of the Claim; and (vii) has complied with the terms of the Agreement and this Section 11. For the purposes of this Section 11, “Covered Software” means the Mirantis Hardened Packages and Licensed Software, as defined in an Exhibit, available for download through the Mirantis Portal.
TERMS OF ELIGIBILITY. (a) Eligibility begins: For eligible new employees, eligibility begins the date of employment. (b) For eligible new employees, the waiting period is 0 days. (c) For employees enrolling their Dependents: Dependent children are eligible through the end of the month in which they attain age 26, regardless of student status, or if age 26 and beyond, to the date they lose eligibility due to the Dependent’s inability to meet all of the requirements contained in Section 3.1 (b) of the Master Group Contract. (d) Part-time employees are covered; minimum hours worked is defined by the District. (e) Any change in coverage selection because of marriage, divorce or death causing a change in enrollment status will be effective the first of the month following the qualifying event.
TERMS OF ELIGIBILITYAn applicant who meets the criteria will be eligible for participation in the Business Sales Program (and referenced herein as a “Member”) upon approval by the Company after presentation of the following:

TERMS OF ELIGIBILITYAn applicant who is an accredited trade professional, including but not limited to an interior designer, architect, home xxxxxx, and general contractor (see professional organization list below), will be eligible for participation in this Trade Partnership (and referenced herein as a “Partner”) upon approval by the Company after completion of the Application form and presentation of the following: Company website or business card indicating the applicant’s name and trade profession Federal Tax ID/EIN Business license or resale certificate showing proof of a design-based business or valid Membership card from one of the following Professional Trade Associations: AIA (American Institute of Architects) APLD (Association of Professional Landscape Designers) ASID (American Society of Interior Designers) ASLA (American Society of Landscape Architects) CID (Certified Interior Decorators International) IDS (Interior Design Society) IIDA (International Interior Design Association) NKBA (National Kitchen and Bath Association) A staging organization, such as ASP, HSR, IRIS or IRN The Company reserves the right to make all partnership determinations at its sole discretion.
