TRANSFERS IN AND OUT OF THE BARGAINING UNIT. An employee who has been or in the future is promoted from the bargaining unit to a supervisory position or other job with the City shall retain the seniority he had acquired as of the time of such promotion and shall continue to accumulate seniority for a period of one (1) year. If such employee is removed from his supervisory or other job with the City for any reason other than discharge for reasons considered valid under this Agreement during the first year in the new position, such employee shall be allowed to return to a job within the bargaining unit in line with his seniority (during the first ninety (90) calendar days he shall be allowed to return to his former job, if it still exists). If he remains in such supervisory or other non-bargaining unit job for a period in excess of one (1) year, he shall cease to have any seniority in the bargaining unit.
TRANSFERS IN AND OUT OF THE BARGAINING UNIT. .21 Employees who are or have been appointed or selected for a supervisory position, or for any position not subject to the provisions of this Collective Agreement, will not be covered by the provisions of this Collective Agreement. However, if any employee on a seniority list covered by this Collective Agreement is transferred or appointed to a position outside of the bargaining unit, and later is transferred back to a position which is covered by this Collective Agreement, then, only the seniority which they held prior to their transfer shall be accredited to them. If the transfer necessitates an employee being displaced, then, the employee with the least plant wide seniority shall be the one displaced. Employees having been employed only in positions outside the Collective Agreement shall, if subsequently employed on a job covered by this Collective Agreement, be considered new hires for the purpose of seniority.

  • Positions outside the Bargaining Unit (a) An employee may substitute temporarily in a position outside the bargaining unit for up to fifteen (15) months from the date of the assignment.   • Transfers and Seniority Outside Bargaining Unit No employee shall be transferred to a position outside the bargaining unit without the employee's consent. If an employee is transferred to a position outside of the bargaining unit, the employee shall retain seniority acquired at the date of leaving the unit, but will not accumulate any further seniority. If such an employee later returns to the bargaining unit, the employee shall be placed in a job consistent with the employee's seniority.
