Waiting Periods (Retention Periods. The retention time of the drug is a critical factor in proving beyond reasonable doubt the charge against a prisoner of drug misuse. So as not to punish the prisoner twice for the same offence of drug misuse and also to guarantee that the drug misuse took place whilst in custody or on Release on Temporary License (ROTL) rather than the period before being remanded or sentenced to prison, NOMS Security Group have taken into account the time taken for the drug to clear from the body; this is referred to as the waiting period. It is during this waiting period that we expect the drug to be cleared from the body so that after the waiting period, it is safe beyond reasonable doubt to conclude that the positive result is due to a new offence having taken place. The waiting times currently in use are given at Annex N (Document 2 Section 3 Lot 4). There is a critical relationship between the waiting times, not least for cannabis, and the cut-off level for the screening test. This relationship must be taken fully into account. The proposal must include a detailed protocol setting out the waiting periods for all drugs tested at the screening stage together with supporting evidence for periods chosen. The protocol will make clear what will be incorporated into statements of evidence when asked to interpret drug test results. This should include the pharmacokinetics of passive inhalation of cannabis, heroin and cocaine. The best evidence constitutes papers published in the scientific literature. Where it is proposed to vary the waiting times from those currently in use, the detailed argument for change must be presented in the proposal. Opiates NOMS Security Group are particularly keen to prove beyond reasonable doubt the use of heroin, where that drug has been misused. The interpretation of opiate positive results presents a particular difficulty due to the metabolic breakdown profile of heroin and the impurities often present in heroin. This is complicated by the presence of codeine in a number of proprietary painkillers. Such painkillers may be available illicitly to prisoners. NOMS Security Group want to distinguish between the different sources of opiates. The relative proportion of opiates detected at confirmation provides good evidence about the drugs used / misused. The proposal should include a statement of the various interpretations possible for differing ratios of opiates detected. This will be included in the confirmation report.
