Written Procedure – Department Head. If the matter is not thereby disposed of, it will be submitted, in written form, by the employee or their xxxxxxx, in duplicate, within ten (10) working days of the occurrence of the facts giving rise to the grievance, to the Department Head who shall acknowledge receipt of the written grievance by signing and dating it. Said Department Head shall, within three (3) working days after receipt, meet with the employee and/or their xxxxxxx and/or Human Resources Director to discuss the grievance and, within two (2) working days thereafter, shall give their written decision and return one copy to the employee or xxxxxxx who shall acknowledge receipt of the written decision by signing and dating it. In cases where a bargaining unit member‟s immediate supervisor or department head is not the subject of an official grievance, the Human Resources Director is to be recognized as the „management representative‟ designated to receive and sign for an official grievance form on behalf of the employer. And the Human Resources Director is to provide a written response within five (5) working days. If the matter is not thereby settled, Section 4 of the Article is the next appropriate step in the grievance process.

Written Procedure – Department Head. If no satisfactory adjustment is 26 made with the Department Head in the Step 1 Verbal Discussion, the 27 aggrieved employee and/or the employee’s representative may within five 28 (5) days, excluding Saturday, Sunday and holidays (recognized under this 29 Agreement), following the answer in the Step 1 Verbal Discussion, submit 30 the grievance to the Department Head in writing. The grievance shall 31 indicate the Section or Sections of this Agreement in dispute and shall as 32 reasonably practicable adequately set forth the facts pertaining to the 33 alleged violation. A written answer shall be given by the Department 34 Head within five (5) days, excluding Saturday, Sunday and holidays 35 (recognized under this Agreement), following the date on which the 36 written grievance was submitted at this Step 1 Written Procedure – 37 Department Head. The written answer of the Department Head shall be 3 (b) Step 2. given to the employee involved or the employee’s representative, whoever is applicable.

  • Grievance Commissioner System This is to confirm the discussion of the parties during collective bargaining that they are committed to encouraging early discussion and resolution of labour relations issues at the local level and seek to resolve grievances in a timely and cost efficient manner. To that end, this is to confirm that pursuant to Article 8, the parties agree that the Employer and Union at individual nursing homes may agree to utilize the following process in order to resolve a particular grievance through the utilization of a joint mediation-arbitration procedure:

  • Grievance Commissioner The Employer and Union may mutually agree in writing to invoke the Commissioner Process rather than proceed to arbitration as set out in this Collective Agreement. All cases referred to arbitration where an employee has a grievance concerning discipline will only be referred to a Grievance Commissioner if the Employer and the Union agree in writing on all the facts. The parties may also agree to group grievances before a single Grievance Commissioner. A Grievance Commissioner (where more than one, acting in rotation) will set aside such time as may be requested by the Employer and the Union to consider and determine grievances referred to them. A Grievance Commissioner shall have the same powers and be subject to the same limitations as a Board of Arbitration hereunder, save and except as expressly provided in 9.18 to 9.22 hereof.

  • Rules of Grievance Processing 1. Time limits of any stage of the grievance procedure may be extended by written mutual agreement of the parties at that step.
