Phase I Work definition

Phase I Work shall have the meaning specified in Exhibit A to this Agreement. “Phase II Work” shall have the meaning specified in Exhibit A to this Agreement.

Phase I Work. Substantially Complete (as defined in the Tenant Work Letter). Notwithstanding the foregoing to the contrary, unless otherwise mutually agreed upon by Landlord and Tenant, in no event shall the Lease Commencement Date occur prior to January 31, 2020. Landlord shall give Tenant at least thirty (30) days prior written notice (which notice may be provided by email to: [redacted], [redacted], and [redacted], or such other email addresses as Tenant may designate from time to time upon written notice to Landlord [such notice referred to herein as “Email Notice”]) of the date of Substantial Completion of the Phase I Work; Tenant shall not be obligated to accept possession of the Phase I Premises prior to the end of such 30-day period.

  • In anticipation of the final inspection requirements, the Department has included a requirement in the Technical Requirements for all Haul Routes to be returned to the preexisting condition prior to commencement of Phase I Construction, as indicated in the Survey of Existing Conditions Prior to Phase I Work.

More Definitions of Phase I Work

Phase I Work. Substantially Complete (as defined in the Tenant Work Letter), which date of delivery of possession is subject to adjustment pursuant to the Tenant Work Letter.” For the four (4) month period prior to the Lease Commencement Date (the “Beneficial Occupancy Period”), Tenant shall be permitted to occupy the Premises (and, for clarity, Tenant shall have the right to use the Parking Areas) subject to complying with all terms and provisions of the Tenant Work Letter and with all of the other terms and provisions of this Lease (including those identified as only applying during the Lease Term), except those provisions requiring the payment of Base Rent and Parking Rent, which shall not apply to Tenant until the Lease Commencement Date (and for clarity, Landlord acknowledges that Tenant’s Base Rent for the first full calendar month after the Lease Commencement Date will be abated subject to Exhibit D to the Lease). For the avoidance of doubt, Direct Expenses shall be due and payable during the Beneficial Occupancy Period. Landlord and Tenant shall enter into a Notice of Lease Term Dates on the form set forth in Exhibit C of the Lease on or prior to the Beneficial Occupancy Start Date (as defined below).
Phase I Work means that portion of the Work comprising all Public Improvements and at least 34,00 s.f. of commercial space as described in Section 3.5.1 hereof.
Phase I Work means all activities necessary to implement the removal of sediments from the Phase I Area identified in Appendix B and the transport and off-site disposal of those materials pursuant to an Action Memorandum to be issued by EPA, Region 2, based on the Phase I EE/CA.

Landlord shall cause the Contractor to construct the Phase I Work to comply with the Phase I Working Drawings and Legal Requirements.
Phase I Work are used in such Agreement of Surety Indemnity, the same shall hereafter mean "Phase IA and Phase IB Work".
Phase I Work means the County’s design and engineering work and land use entitlements and other governmental approvals required for the Project, which may include those work items set forth in Exhibit A.
