Protected Award Conditions the meaning given under s.354 of the Act as amended.
Protected Award Conditions. Any protected award conditions, as defined in s354 of the Workplace Relations Act 1996, (including an incidental term or related machinery provision) are hereby expressly excluded from this Agreement. To be specific, where an Award (whether a Federal Award or Notional Agreement Preserving State Award) would apply to the employment of an employee covered by the terms and conditions of this Agreement but for this Agreement, any terms of such Award, addressing the subject matter of the following, are hereby expressly excluded from the terms and conditions of this Workplace Agreement: • Public holidays (including substituted days) and payment for public holidays or substituted days • Rest breaks (including meal breaks) • Annual leave loadings • Allowances • Penalty rates • Incentive based payments and bonuses • Overtime loadings • Shift loadings
Protected Award Conditions has the same meaning as given to it in section 354 of the Act.

  • The list below lists the major Protected Award Conditions which have been modified or removed by this Agreement.

  • If this Agreement is terminated (other than where the Agreement is replaced by a new Agreement) the Australian Fair Pay and Conditions Standard and the Protected Award Conditions of the relevant and applicable Award will constitute the terms and conditions of employment of employees.

More Definitions of Protected Award Conditions

Protected Award Conditions has the same meaning as that terms is defined in the Act; and
Protected Award Conditions mean those conditions specified in section 354 of the Act, which includes: observance of days declared as public holidays under law; substitution of public holidays declared by law; rest breaks; shift/overtime loadings; annual leave loadings; monetary allowances; penalty rates; incentive-based payments and bonuses; and any other matter specified in Regulations.
Protected Award Conditions means Protected Award Conditions (however described) within the framework of the Workplace Relations Legislation. For the avoidance of doubt, a reference to "Protected Award Conditions" includes a reference to Protected Notional Conditions as described by the Workplace Relations Legislation.
Protected Award Conditions means the terms of an award, as in force from time to time, to the extent that those terms: 3.11.1 are: 3.11.1 (a) about protected allowable award matters as set out on section 354(4) of the Workplace Relations Act; or 3.11.1 (b) terms that are incidental to protected allowable award matters and that may be included in an award as permitted by section 522 of the Workplace Relations Act; or 3.11.1 (c) machinery provisions that are in respect of protected allowable award matters and that may be included in an award as permitted by section 522 of the Workplace Relations Act; and 3.11.2 are not about: 3.11.2 (a) matters that are not allowable award matters because of section 515 of the Workplace Relations Act; or 3.11.2 (b) any other matters specified in the regulations of the Workplace Relations Act.
Protected Award Conditions means any protected award conditions, as defined by the Act, that may apply but for this Agreement, to employees covered by this Agreement including rest breaks, incentive-based payments and bonuses, annual leave loadings, public holidays and substitute holidays, monetary allowances for expenses, skills, disabilities or responsibilities associated with the performance of particular tasks or work in particular conditions or locations, loadings for working overtime or for shift work, penalty rates and outworker conditions. Redundancy: means where the Company has made a definite decision that the Company no longer wishes the job the employee has been doing done by anyone and that decision leads to the termination of employment of the employee, except where this is due to the ordinary and customary turnover of labour. spouse: includes a former spouse, a de facto spouse and a former de facto spouse. Transmitted: includes a transmission by way of transfer, conveyance, assignment or succession whether by agreement or by operation of law. weeks pay: means the ordinary time rate of pay for the employee concerned and, without limitation, shall exclude:
