Protective Period definition

Protective Period means that period of time during which a displaced or dismissed employee is to be provided protection hereunder and extends from the date on which an employee is displaced or dismissed to the expiration of 6 years therefrom, provided, however, that the protective period for any particular employee shall not continue for a longer period following the date he was displaced or dismissed than the period during which such employee was in the employ of Railroad prior to the date of his displacement or his dismissal. For purposes of this Appendix, an employee’s length of service shall be determined in accordance with the provisions of section 7 (b) of the Washington Job Protection Agreement of May, 1936.

Protective Period means the period that commences six months prior to and ends two years following the effective date of a Change of Control.

Examples of Protective Period in a sentence

  • Such reduction or suspension shall continue for the duration of the Protective Period, unless and until the Dismissed Employee’s then- current compensation is reduced or eliminated.

  • A Dismissed Employee shall be paid a monthly dismissal allowance from the date they are deprived of employment through the Protective Period.

  • If a Dismissed Employee accepts new employment (or reemployment by the dismissing Railroad) during the Protective Period, the dismissal allowance shall be reduced such that the accepted monthly compensation at the then-current position (including any unemployment insurance compensation received) plus the dismissal allowance is equivalent to the Dismissed Employee’s Average Monthly Compensation.

  • However, if the elected protection expires pursuant to the terms of the arrangement that governs the elected protection, the Protected Employee is entitled to protection under the arrangement not originally elected for the remainder, if any, of the Protective Period.

  • The Displacement Allowance shall cease prior to the expiration of the Protective Period in the event of the Displaced Employee’s resignation, death, retirement, or dismissal for justifiable cause.
