The Company will notify Publisher without undue delay upon becoming aware that an actual Security Incident involving the Publisher Data in Company’s possession or control has occurred, as Company determines in its sole discretion.
The duration shall be for the terms of the partnership with an additional period from the expiration of the partnership until deletion of Publisher Data by the Company in accordance with the terms of this DPA.
The Company shall make available, solely upon prior written notice and no more than once per year, to a reputable auditor nominated by the Publisher, information necessary to reasonably demonstrate compliance with this DPA, and shall allow for audits, including inspections, by such reputable auditor solely in relation to the Processing of the Publisher Data (“Audit”).
In relation to all Publisher Data, the Company acknowledges that, as between the parties, Publisher is the Controller of Company Data, and that the Company, in providing the services is acting as a Processor on behalf of the Controller.
Publisher Data Means Site, user and third party data related to Publisher Sites It shall also include any profile information, data, and other content or information provided by the Publisher, directly or indirectly, to AdPushup in connection with the Publisher’s use of the Service, including without limitation such data, content, and information related to Publisher’s business or the users of the Publisher Sites.
Such Reports or Customer Portal may also provide Advertiser with access to certain aggregated ratings, statistics, analysis, End User Information, or other meta-content (collectively, "Publisher Data").
Advertiser acknowledges that Publisher Data, Third Party Content, and End User Information collected by Publisher (including Retained Information) may be used by Publisher, subject to Publisher’s Privacy Policy, for the purpose of providing relevant advertising to End Users viewing or using Publisher Properties or third-party digital Properties, and that such relevant advertising may include advertising provided for third parties, including third parties that Advertiser might consider to be competitors.
Advertiser acknowledges and agrees that all Publisher Data and Third Party Content is made available for Advertiser’s informational purposes only.
Publisher shall discontinue all use of the Services, deactivate and delete the Fyber SDK in the Publisher Properties, and shall have no right, interest, or title in or to any Account Data or Tracking Data (other than Publisher Data and User Data directly collected by Publisher from its Users), which shall, as between Publisher and Fyber, be the exclusive property of Fyber.
Any IP Rights in the Publisher Data shall belong to and inure to the benefit of Publisher.
