Rights of Representation. A grievant may be represented at all stages of the grievance by an Association representative(s).

Paragraph 1: At any level of the grievance procedure, at the grievant’s option the grievant shall be represented by the UTW, himself/herself, legal counsel or another person selected by the grievant. Provided, however, if an attorney is going to be present at a Level Two hearing for either the administration or UTW, the other side will be notified at least three (3) days prior to the hearing.

In accordance with applicable Government Code, a unit member may process a grievance through Level IV without an Association-designated representative provided that any adjustment reached prior to arbitration is consistent with the terms of the Agreement. If a unit member presents a grievance on his/her own behalf, the Association shall have the right to be notified of the grievance and to be present and state its views at all levels. The District shall not agree to a resolution of the grievance until the Association has received a copy of the grievance and its proposed resolution and has been given the opportunity to file a response.
Rights of Representation. 21.18.1 The Association retains the right to represent those whose appointments have been terminated under this Article.

Any party may be represented at all meetings and hearings at any level of the grievance procedure by another teacher or another person provided, however, that no teacher may be represented by an officer, agent, or other representative of any organization other than the Association. Rights of Representation. A staff member covered by this Agreement shall have the right to have an Association representative present at any time, subject to his/her requesting such representation.

When an employee is required to appear before the Board or any administrator concerning any matter directly involving discipline or which could lead to discipline of that particular employee, the employee shall be entitled to have a representative of the Association present. When an employee is required to so appear, he/she shall have reasonable advance notice of the reason for the appearance.
Rights of Representation. 1. The Association President or Grievance Chair must be informed by the district of all grievances served. Either the President, Grievance Chair or their designee must be part of any settlement decisions. The President, Grievance Chair or their designee has the right to be present for any meetings, hearing, appeals, or other proceedings related to a grievance, which has been formally presented.
2. A grievant may represent him or herself from Level 1 through Level 4 of the grievance procedure or may be represented by the Association. If a grievant is not represented by the Association through Xxxxx 0, the Association shall have the right to be present and to state its view, with witnesses if necessary, at all stages. At Xxxxx 0, the Association owns the grievance and will be responsible for providing Association Counsel. Only the President of the Association or his/her designee has the right to speak regarding the position of the Association. No bargaining unit member is entitled to be represented by private counsel at any stage of the grievance procedure.
