Voluntary Separation definition

Voluntary Separation means an employee whose employment has been terminated and whose position is filled by another employee who was about to be or has been given a lay-off notice, or who has been laid-off and is on the priority list as a result of a lay-off.
Voluntary Separation means the termination of a Covered Employee’s employment from a Covered Employer as a result of the Covered Employee voluntarily resigning at his/her own instance without having been requested to do so by the Covered Employer, excluding circumstances beyond a Covered Employee’s control, including, but not limited to, circumstances where the employer is responsible for the employee’s separation (e.g., the employer does not return the employee to his/her same position or reinstate the employee to a comparable position or fails to provide employee with lactation accommodations), or circumstances where the employee is needed to care for a seriously ill family member (e.g. the employee’s new child has a serious health condition requiring the employee’s full-time care).
Voluntary Separation means: (i) an employee whose employment has been terminated and whose position is filled by another employee who was about to be or has been given a lay-off notice or who has been laid-off and is on the priority list as a result of a lay-off. (ii) an employee whose position has been transferred to a new community and the employee chooses not to transfer with the position. (iii) An employee who may be subject to lay-off because of the elimination of a position and chooses termination and the benefits under Article 32.08, in accordance with the Memorandum of Understanding – Voluntary Separation in Cases of Elimination of Position.

More Definitions of Voluntary Separation

Voluntary Separation as used in the statute means leaving employment of one’s own free will. It includes resignations other than those submitted at the employer’s insistence and failure to return to work following a temporary layoff or leave of absence. A claimant discharged because of volitional acts which leave the employer no choice but to terminate the employee, pursuant to law, governmental regulations or contract is also considered to have voluntarily separated from employment.
