Accessibility of Services. Services must not discriminate on the basis of age, disability, sex, race, color, national origin or religion. Recipients must comply with Title VI of the Civil Rights Act of 1964 (42 U.S.C. § 2000d et seq.), Title IX of the Education Amendments of 1972 (20 U.S.C. § 1681 et seq.), Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. § 701), the Age Discrimination Act of 1975 (42 U.S.C. § 6101 et seq.), and any provisions required by the implementing regulations of the Federal Agency providing the funds. Accessibility of Services. The LME shall establish and maintain a Provider Network with a sufficient number, mix, and geographic distribution of Providers to ensure that medically necessary Covered Services are delivered in a timely and appropriate manner, according to the Access Standards specified in Attachment T and elsewhere in this Contract. The LME shall establish policies and procedures to monitor the adequacy, accessibility, and availability of its Provider Network to meet the needs of all Enrollees, including Enrollees with limited proficiency in English. The LME shall conduct analyses of its Provider Network prior to entering into a contract with DMA; annually thereafter; and at any time there has been a significant change in the LME’s operations that would affect adequate capacity and services, including changes in services, geographic service areas, payments, or enrollment of a new population in the LME. In conducting the analyses, the LME shall consider: a. Anticipated membership numbers, characteristics, and needs, including the cultural and language needs of Enrollees; b. Anticipated service utilization; c. Numbers and types of Providers required to provide the contracted services, including training, experience, and specialization; d. The number of Network Providers who are not accepting new referrals; and e. The geographic locations of Providers and recipients, considering travel distances, travel times, means of transportation, and physical access for Recipients with disabilities. The LME shall submit to DMA written reports of findings of the Provider Network analyses. Whenever network gaps are identified, the LME shall submit to DMA a network development plan within a timeframe specified by DMA. Provider selection procedures shall not discriminate against Providers that serve high-risk populations or specialize in conditions that require costly treatment. If specialty services are Medically Necessary but are not available in-network, the LME shall arrange for these services to be provided out-of-network. The LME shall adequately and timely cover these out-of-network services for as long as the LME is unable to provide them in-network. The LME shall ensure that no incentive is given to Providers, monetary or otherwise, for withholding medically necessary services. Accessibility of Services. Extended hours or flexible schedules are to be implemented in order to accommodate the needs of the Subgrantee catchment area to ensure that services are accessible to all citizens of South Carolina. Providers of Withdrawal Management (Detoxification) and Residential services must be open for services 24 hours a day, seven days a week, and 365 days a year. In addition, anytime during the 24/7 period of operation, when beds are vacant and a prospective patient presents for services and is appropriate for admission, the individual must be admitted.
Accessibility of Services. Provider shall make readily available and accessible Covered Services to Covered Persons at the locations designated by TMHC in accordance with the Management Agreement during normal business hours, and Provider shall be reasonably available to provide Covered Services after hours. Emergency Services shall be available on a twenty-four hours a day/seven days a week basis.
Accessibility of Services. Subgrantee shall accommodate the needs of the Subgrantee’s catchment area and ensure that services are accessible to all citizens, by and through the implementation of extended hours or flexible schedules. If Subgrantee provides Withdrawal Management (Detoxification) and/or Residential services, Subgrantee must ensure that these services are continuously accessible 24 hours a day, seven days a week, and 365 days a year. Additionally, Subgrantee shall make every effort to admit prospective patients when beds are available, and where the prospective patients present for services and are appropriate for admission.

  • Inspection of Services Subcontractor shall make the Services accessible at all reasonable times for inspection by the Contractor. Subcontractor shall, at the first opportunity, inspect all material and equipment delivered to the job site by others to be used or incorporated in the Subcontractor’s Services and give prompt notice of any defect therein. Subcontractor assumes full responsibility to protect the work done hereunder until final acceptance by the Contractor or any authorized third (3rd) party.

Accordingly, Grantee must provide electronic and information resources and associated Product documentation and technical support that comply with the Accessibility Standards.
