Acknowledgement and Assumption of Risk. Releasor acknowledges the contagious nature of COVID-19 and voluntarily assumes the risk that Releasor may be exposed to or infected by COVID-19 arising out of and/or related to the Competition, including but not limited to travel to/from the venue, accommodation, training for and participation in the Competition or any Company-sanctioned activity, use of the Company’s equipment or facilities and/or using any equipment or facilities rented or leased by the Company and that such exposure or infection may result in personal injury, illness, permanent disability, and death. Releasor understands that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of Releasor’s own acts or those of others. Releasor assumes full responsibility for any loss, damage or personal injury, illness or disability including death, that Releasor may sustain as a result thereof, whether caused by the negligence of any of the Released Parties or otherwise, including without limitation as a result of negligent emergency operations. Releasor hereby represents and warrants that, to the best of Releasor’s actual or constructive knowledge, there is no reason, medical or otherwise, that would make any such participation or use unusually hazardous for Releasor personally. Releasor voluntarily agrees to assume all of the foregoing risks and accept sole responsibility for any personal or economic claim, liability or loss of any kind to Releasor (including, but not limited to, loss, damage, personal injury, illness or disability including death) that Releasor may experience or incur in connection with Xxxxxxxx’s relationship
Acknowledgement and Assumption of Risk. Licensee recognizes that attendance in or at the Stadium for events or any other reason by Licensee and/or its guests, its invitees and those for whom Licensee is at law responsible, including any minor(s) accompanying the Licensee (collectively, the “Attendees”) is voluntary and may result in illness, physical and/or mental injuries, medical complications, disability, death, and/or property damage, both foreseen and unforeseen. Licensee, by accepting the Agreement, by using a Ticket, by attending or observing the Event or by participating in any attractions offered in connection with the Event (“Attractions”) or otherwise in or at the Luxury Suite or the Stadium, acknowledges and assumes (on behalf of themselves and any Attendee(s)) all risks and dangers associated with being a spectator before, during, and after an event taking place at the Stadium (including all performances, attractions and other activities) whether any such risk or danger occurs prior to, during or subsequent thereto, including specifically (but not exclusively) the danger of being injured by thrown, dropped, or launched items; projectiles; persons; animals; other hazards or distractions; and any incidents or accidents associated with crowds of people or the negligence or misconduct of other spectators. Further, and without limiting the generality of the foregoing, Licensee acknowledges and understands that by attending in or at (or interacting with staff, participants, and/or any other individuals present in or at) the Luxury Suite and/or the Stadium for any reason, including for the purpose of viewing any Event, Licensee (and/or any Attendee(s)) may be exposed to the Coronavirus, COVID-19, influenza, or other airborne, aerosolized or surface transmissible infections and/or communicable diseases, viruses, bacteria or illnesses (collectively, “Communicable Diseases”). Licensee acknowledges and understands that SARS-CoV-2 is extremely contagious and spreads mainly from person-to-person contact. Based on currently available information, older adults and people of any age who have serious underlying medical conditions may have a higher risk for severe illness or death from the Coronavirus and COVID-19. THE LICENSOR CANNOT GUARANTEE THAT LICENSEE (AND/OR ANY ATTENDEE(S)) WILL NOT BECOME EXPOSED TO OR INFECTED WITH THE CORONAVIRUS, COVID-19, OR ANY OTHER COMMUNICABLE DISEASES, DESPITE ANY SANITIZATION OR OTHER EFFORTS THAT MAY BE IMPLEMENTED IN ORDER TO MITIGATE SUCH DANGERS.

Residents also acknowledge and agree, on behalf of themselves and any minor child/children that accompany them to the Common Areas, that the Association owes no duty to any person to prevent such person from contracting Coronavirus, SARS-CoV-2 and COVID-19, nor does the Association owe person any duty to prevent such person from coming into contact with other persons infected with Coronavirus, SARS-CoV-2 and COVID-19. By entering, utilizing and occupying the Common Areas, all persons do so at their own sole volition and risk having full knowledge of the risks inherent in entering, utilizing and occupying the Common Areas during the COVID-19 pandemic.
