Licensee recognizes that attendance in or at the Stadium for baseball games or any other reason by Licensee and/or its guests, its invitees and those for whom Licensee is at law responsible, including any minor(s) accompanying the Licensee (collectively, the “Attendees”) is voluntary and may result in illness, physical and/or mental injuries, medical complications, disability, death, and/or property damage, both foreseen and unforeseen. Licensee, by accepting the Agreement, by using a Ticket, by attending or observing the Game or by participating in any attractions offered in connection with the Game (“Attractions”) or otherwise in or at the Group Space or the Stadium, acknowledges and assumes (on behalf of themselves and any Attendee(s)) all risks and dangers associated with being a spectator before, during, and after a baseball game or other event taking place at the Stadium (including all performances, attractions, warm-ups, practices, pre-game, post-game, between-inning and other activities, promotions and competitions) whether any such risk or danger occurs prior to, during or subsequent thereto, including specifically (but not exclusively) the danger of being injured by thrown, dropped, or launched items; thrown bats; bat fragments; thrown or batted balls; projectiles; protective netting flexing inward toward the spectator seating area; persons; animals; other hazards or distractions; and any incidents or accidents associated with crowds of people or the negligence or misconduct of other spectators. Further, and without limiting the generality of the foregoing, Licensee acknowledges and understands that by attending in or at (or interacting with staff, participants, and/or any other individuals present in or at) the Group Space and/or the Stadium for any reason, including for the purpose of viewing any Game, Licensee (and/or any Attendee(s)) may be exposed to the Coronavirus, COVID-19, influenza, or other airborne, aerosolized or surface transmissible infections and/or communicable diseases, viruses, bacteria or illnesses (collectively, “Communicable Diseases”). Licensee acknowledges and understands that SARS-CoV-2 is extremely contagious and spreads mainly from person-to- person contact. Releasor acknowledges the contagious nature of COVID-19 and voluntarily assumes the risk that Releasor may be exposed to or infected by COVID-19 arising out of and/or related to the Competition, including but not limited to travel to/from the venue, accommodation, training for and participation in the Competition or any Company-sanctioned activity, use of the Company’s equipment or facilities and/or using any equipment or facilities rented or leased by the Company and that such exposure or infection may result in personal injury, illness, permanent disability, and death. Releasor understands that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of Releasor’s own acts or those of others. Releasor assumes full responsibility for any loss, damage or personal injury, illness or disability including death, that Releasor may sustain as a result thereof, whether caused by the negligence of any of the Released Parties or otherwise, including without limitation as a result of negligent emergency operations. I understand, or will educate myself about prior to the Half Marathon, the dangers of dehydration and hyponatremia (low blood sodium) and will take precautionary measures to prevent these conditions. I acknowledge that I am solely responsible for my personal health and safety, and the personal property I bring with me. I also acknowledge and accept full and sole responsibility for any medical expenses arising from my participation in the Half Marathon. I further acknowledge that my participation in the Half Marathon is strictly voluntary. I understand that I may discontinue my participation in the Half Marathon at any time, at my sole discretion.

I understand that I am solely responsible for my own safety, and for taking every precaution to provide for my safety and well-being, while participating in the Trip. a. narrow or nonexistent trails; rough, exposed, unstable, steep or slippery terrain; high-altitude illness; lightning; cold weather; avalanches, icefall or rockfall, and other risks of wild and unfamiliar terrain and locations;
b. wild or poisonous animals, insects or plants; dangerous river or water crossings; fires or floods; other forces of nature;
c. equipment malfunctions or failure;
d. extreme remoteness from, and unavailability of, medical facilities or rescue;
e. travel by motor vehicles or other conveyance;
f. acts or omissions by the CMC, its employees, agents, instructors, volunteers or members, including but not limited to those of the Trip leader;
g. acts or omissions by others, including but not limited to Trip participants and third party vendors, including but not limited to vendors supplying transportation, lodging, and services in foreign countries;
h. interruption, cancellation, or unforeseen difficulties in transportation and travel, including but not limited to, the complete unavailability of transportation for extraction and repatriation even in emergency situations;
i. cultural, political, and violent events in foreign lands, including but not limited to the criminal conduct of others; and
