Actions to be Taken Under the Program. The actions to be taken by the Recipient under the Program include the following: The Recipient's Court of Account has published its report on the implementation of the Recipient's 2008 budget law (loi des finances 2008) and the Recipient's Ministry of Finance and Budget has submitted the 2008 budget review law (loi de reglement 2008) to the Recipient's Parliament. The ARMP has endorsed a report which assesses the Recipient’s compliance with the provisions of the Procurement Code and identifies any necessary corrective measures. The Recipient has settled at least CFAF500,000,000 of arrears due to small- and medium-businesses in accordance with the Arrears Order. The Recipient has adopted: (i) a framework document for a national tracking system, and (ii) a framework document for a system of verification of the legality of timber productions, in compliance with FLEGT. The Recipient has posted on official websites its second EITI report covering years 2007, 2008 and 2009, and such report has been disseminated in the Recipient’s territory. The Recipient has adopted legislation and/or regulations on the downstream petroleum sector which: (i) set forth the respective roles and responsibilities of each of the ASRP, SOCASP and the Recipient’s Ministry of Mines and Energy (Ministère des mines et de l’énergie) in the downstream petroleum sector; and (ii) set forth the methodology for determining the price of petroleum products in the Recipient’s territory. An audit report on, inter alia, the use of funds by the ASRP has been prepared by an independent consultant(s) and endorsed by the Recipient’s Ministry of Finance and Budget. The Recipient has reduced administrative costs arising from (A) the creation of a business and (B) the transfer of urban commercial real property (mutation d’immeubles urbains xxxxx et non-xxxxx) by amending the Recipient’s Registration Code (Code de l’enregistrement) so as to reduce the registration fees in connection with: (i) the creation of a business; and (2) the transfer of urban commercial real property (mutation d’immeubles urbains xxxxx et non-xxxxx), each by at least fifty percent (50%).
Actions to be Taken Under the Program. The actions to be taken by the Recipient under the Program include the following:
(i) The Recipient shall appoint, by Presidential decree approved by the Council of Ministers and duly published in the Official Gazette, the following persons in charge of the new structures created at the Treasury: (A) the General Director (Directeur Général), (B) the General Accountant (Agent Comptable Central du Trésor), (C) the General Xxxxx (Xxxxxx Général du Trésor), and (D) the General Collector (Xxxxxxxx Général du Trésor);
(ii) The Recipient shall: (A) adopt guidelines and audit techniques to be applied by its Chamber of Account (Chambre des Comptes), satisfactory to the Association, by decision (Note de Service) of the President of the Chamber of Accounts of the Recipient; and (B) begin to implement them;
(iii) The Recipient shall: (A) adopt by Presidential decree approved by the Council of Ministers and duly published in the Official Gazette the regulatory texts for the organization and operation of the Recipient’s Direction of Control of Public Procurement (Direction Générale du Contrôle des Marchés Publics), in form and substance satisfactory to the Association; and (B) appoint the two central directors (Director of Information and Director of Statistics) for said Direction by Presidential decree approved by the Council of Ministers and xxxx published in the Official Gazette, so that said Direction becomes effectively operational;
(iv) The Recipient shall adopt by Presidential decree approved by the Council of Ministers and xxxx published in the Official Gazette a multi-annual plan for the development of statistics (2008-2012), in form and substance satisfactory to the Association;
(v) The Recipient shall: (A) adopt the revised National Emergency Plan for the management of food crises by Presidential decree approved by the Council of Ministers and duly published in the Official Gazette; and (B) begin its implementation;
(vi) The Recipient shall: (A) adopt, by arrêté from the Recipient’s relevant Minister duly published in the Official Gazette, an action plan, in form and substance satisfactory to the Association, for the improvement of irrigation on the perimeters of ONAHA (Office National des Aménagements Hydro-Agricoles), and (B) shall begin its implementation on the basis of the recommendations of the report on the assessment of the improvement of irrigation on the perimeters of ONAHA currently being carried out at the request of the Recipient’s Ministry in ch...
Actions to be Taken Under the Program. The actions to be taken by the Recipient under the Program include the following:
1. Production of a comprehensive and accurate quarterly budget execution report, in form and substance satisfactory to the Association, and based on the interim computerized integrated financial management information system (budget allocations, commitments, liquidations, payment orders, payments), commencing with that covering the first quarter of 2006.
2. Submission to the National Assembly of a revised public procurement law, in form and substance satisfactory to the Association.
3. Achievement of progress, in form and substance satisfactory to the Association, and as certified by an independent external audit, in implementation of the Recipient’s strategy for the settlement of its arrears to the private sector, including banks.
4. Adoption of a three-year (2006-08) rolling action plan, in form and substance satisfactory to the Association, and including the following elements, for purposes of reform of the Recipient’s coffee sector: (i) restructuring of sectoral debt; (ii) establishment of a legal, regulatory and institutional framework consistent with the liberalization and privatization of the sector; (iii) establishment of modalities for the management and financing of critical services in the sector, notably procurement of inputs, quality control, technical dissemination and advice, research and road rehabilitation and maintenance; (iv) elaboration of a strategy for privatization of the Recipient’s assets in the sector (washing stations and factories managed by Société de Déparchage et de Conditionnement du Café (Coffee Curing and Packing Company)); and (v) appropriate accompanying measures, notably a social plan in the event of layoffs, institutional support and capacity building.
5. Re-launch, in form and substance satisfactory to the Association, of the bidding process for: (i) the sale of all of Office du Café du Burundi (Coffee Board of Burundi)’s assets in sectors other than coffee; and (ii) of all of its shares in Société Hôtelière Nouvelle du Burundi (New Hotelier Company of Burundi).

1. The Borrower shall complete privatization of at least three HZ subsidiaries.

(a) adopt a new job classification system for the civil service; and (b) enact a new Law on Civil Service Salaries, acceptable to the Bank and including, inter alia, provisions for decompression and performance-based remuneration.

1. The Executive Regulations for the newly enacted corporate income tax law, satisfactory in substance to the Association, have been issued.

3. The Recipient has taken all action necessary, including regulatory action, to establish a procurement policy monitoring board to monitor procurement policy and undertake its regulatory functions utilizing a procurement management information system satisfactory to the Association.
4. The Recipient has complied with the EITI principles and criteria by publishing the independently audited accounts of the Recipient documenting all material payments made to the Recipient by oil, gas and mining companies operating in the Republic of Yemen (“payments”) and all material revenues received by the Recipient from such oil, gas and mining companies (“revenues”) in a publicly accessible, comprehensive and comprehensible manner.
5. The Recipient has completed the implementation of the Recipient’s civil service fund program for the period June 2007-May 2008.
6. The Recipient has consistently applied the provisions of the 2005 Wage Law which requires government agencies of the Recipient to meet defined reform criteria before making any future salary increases.
7. The Recipient has taken all actions necessary for the establishment of a computerized employee databases including biometric identification information system, all satisfactory to the Association, with coverage extended to all employees on the state payroll in all sectors.
Actions to be Taken Under the Program. The actions to be taken by Orissa under the Program referred to in Part C of Schedule 1 to the Financing Agreement and the Loan Agreement include the following:
1. Orissa has made progress, satisfactory to the Association and the Bank in carrying out the Program.
2. The macroeconomic policy framework of Orissa is appropriate, including further strengthening of the fiscal position beyond FY 2005-06 towards achieving the targets and objectives of the Medium-Term Fiscal Plan.

The Borrower, through MINED, has: (a) implemented a strategy to address non- performing schools deficiencies in all schools with average grades of 5 points or less in the PAESITA Test; and (b) undertaken a special mid-term test for targeted non-performing schools to assess progress and improvements.
