ANNUAL & CULTURAL LEAVE. 10.1 Rate of Accrual & Cashing Out of Annual Leave As per the National Employment Standards in the Fair Work Act 2009 (section 87 (1)(a), Employees will be entitled to the following: - Full- time and part-time employees get 4 weeks of annual leave, based on their ordinary hours of work. Annual leave accumulates from the first day of employment, even if an employee is in a probation period. The leave accumulates gradually during the year and any unused leave will roll over from year to year. Annual Leave accumulates when an employee is on: • paid leave such as paid annual leave and paid sick and xxxxx’s leave • community service leave including jury duty • long service leave Annual leave does not accumulate when the employee is on: • unpaid annual leave • unpaid sick/xxxxx’s leave • unpaid parental leaveunpaid family and domestic violence leave. The Australian Government’s Paid Parental Leave Scheme is not considered to be paid leave. An Employee does not accumulate annual leave while being paid by the Paid Parental Leave Scheme, if the person is taking unpaid leave from their Employer at this time. Leave does not accumulate for a period of annual leave that has been cashed out.

  • Annual Leave (a) An employee may elect with the consent of the employer, subject to the Annual Xxxxxxxx Xxx 0000, to take annual leave not exceeding five days in single day periods or part thereof, in any calendar year at a time or times agreed by the parties.

  • Cultural Leave Where such leave is approved by the employer, teachers participating in recognised cultural activities within New Zealand or outside New Zealand are entitled to leave with pay on the same conditions as for sports leave.

  • ANNUAL LEAVE (VACATION) A.   • Annual Leave Loading (a) In addition to their ordinary pay, an employee, other than a shiftworker, will be paid an annual leave loading of 17.5% of their ordinary pay on a maximum of 152 hours/four weeks annual leave per annum.

  • CULTURAL LEAVE FOR ABORIGINAL EMPLOYEES The Superintendent of Schools or their designate, may grant five (5) paid days per year leave with seven (7) days written notice from the employee to participate in Aboriginal Cultural event(s). Such leave shall not be unreasonably denied.

  • Annual Leave Entitlement 35.1.1 Annual leave is provided for in the NES. It does not apply to Casual Employees. Except for Casual Employees and Shift workers, Employees will be entitled to four (4) weeks (152 hours) of paid annual leave for each year of service with the Company.

  • Annual Leave Accrual If an employee leaves State Classified employment and is later rehired, he/she shall accrue annual leave at the same rate as a new hire. However, once a rehired employee has been in pay status for five (5) years, all previous service time shall be credited for annual leave accrual. The only exception shall be for employees rehired who repay severance pay received.

  • Medical Leaves of Absence When recommended by an employee's personal physician in writing, a medical leave of absence for a three (3) month period will be granted by the Sheriff. Such leave may be extended for a like three (3) month period or shorter period, within the sole discretion of the Sheriff, up to a maximum of one (1) year. Such extension, if granted, shall be based upon the written certification by the employee's physician that the continued illness or disability precludes the employee from working and the continuation of the leave of absence is necessary. Such leave, up to a maximum of three (3) months, if granted, will be allowed and credited as continuous county service, i.e. seniority continues for the three (3) months only. The employee shall be entitled to his former position or a position for which he is able and capable of performing upon return to work. A medical leave of absence shall be without pay and other fringe benefits, except an employee may use his accumulated sick leave time and accumulated vacation time to avoid loss of wages during such leave.

  • Graduation Leave It is understood that in the case of secondary or post secondary graduation of self or spouse, son or daughter, one day leave with pay shall be granted. Two (2) days leave with pay shall be granted where travel arrangements necessitate such absence from school.

  • Medical Leave of Absence Where you have a medical leave of absence due to any medically determinable physical or mental impairment that can be expected to result in death or can be expected to last for a continuous period of not less than six months, and you have not returned to employment with the Company or an Affiliate, a Separation from Service has occurred on the earlier of: (A) the first day on which you would not be considered “disabled” under any disability policy of the Company or Affiliate under which you are then receiving a benefit; or (B) the first day on which your medical leave of absence period exceeds 29 months.
