Public holidays during annual leave. (a) Annual leave shall be exclusive of public holidays prescribed by this Agreement. Provided that annual leave may be inclusive of public holidays for the purpose of allowing for shift rostering, in which case public holidays falling during any period of annual leave shall be paid at single ordinary time in addition to the payment of annual leave. (b) An employee shall forfeit the right to payment for any public holiday within or immediately following the period of annual leave if the employee fails, without reasonable cause, to report for duty at the proper time after the period of annual leave.

Public holidays during annual leave. Where a public holiday occurs in a period of annual leave, the public holiday will not be deducted from the employee’s annual leave credits. Payment of unused accrued annual leave is available to employees when their APS employment ceases. Payment will be calculated using the employee’s final rate of salary, including allowances that would have been included in the employee's pay during a period of annual leave. The delegate may approve an employee to cash out annual leave. A maximum of 10 days annual leave (pro-rata for part-time employees) can be cashed out during each financial year, subject to the employee: providing Finance with a written election to forgo the entitlement to the amount of annual leave; retaining an entitlement to at least four weeks paid annual leave; and having taken or have had approval to take at least five days annual leave (pro-rata for part-time employees) in the same financial year. The payment for cashed out annual leave will be the same as what the employee would have been paid if they took the leave. Annual leave cannot be cashed out in advance of it being credited to the employee. Where approved by the delegate, employees may purchase from one to four weeks additional leave each year. The purchased leave will be credited to the employee on its purchase, and must be taken within 12 months from the date that the leave was credited to the employee. Where approved by the delegate, employees may purchase from one to eight weeks additional leave, from the time of the expected birth, adoption or long-term fostering of a child, and to be taken within 12 months of the birth, adoption or fostering of a child. Purchased leave must be taken at full pay unless otherwise approved by the delegate as an exceptional circumstance.
